Lead Counsel, Insurance Defense The candidate will be responsible for managing Insurance Defense and Tort Litigation / Disputes work and related issues/matters. Represent insured s and the Company in the defense of bodily injury and property damage lawsuits, subrogation, and company cases. Oversee the activities of a team including attorneys, paralegals and support staff. Prepare for and conduct hearings, trials, arbitrations, mediations, and depositions. Prepare and argue pre and post-trial motions. Assist colleagues in the resolution of calendar conflicts. Provide project management, coordination, and collaboration between legal teams within L&R and with business clients. Conduct research, substantive drafting, reviewing, advising, and negotiating for more complex matters. Provide budget oversight. Supervise direct reports, attorneys, paralegals and administrative assistants. Write and conduct performance reviews of team members, including checkpoints and Peromance Development Summary. Provide coaching and support to team members. Perform quality file reviews. Work as part of management team with Managing Attorney. Review new file assignments and approve initial pleadings, propound discovery, and/or develop strategy. Contact clients to discuss their case and answer any questions. Contact claims (initial litigation plan, recurring minimum 90 day contact, strategy conferences, etc.). Review all documentary evidence. Prepare witnesses and clients for depositions, arbitrations, mediations and trials including expert witnesses. Conduct depositions and examinations under oath and prepares summary documents. Prepare and conduct court appearances (matter management conferences, hearings, status conferences, etc.). Conduct settlement/dispositive proceedings (e.g. mediations, arbitrations, etc.). Try and/or arbitrate cases and prepares motions in liminie and summary documents. Draft post-trial motions. Prepare for and participate in appeals. Investigate and pursue subrogation litigation as appropriate. Second chair cases with Trial Attorneys and Senior Trial Attorneys as needed. Monitor allocated legal expenses, track factors that drive variations, and collaborate with claims clients regarding status of contributing factors. Administer company Human Resources policies. Legal Advice and Counseling. Accountable for due diligence; delegates due diligence responsibilities to Law Clerks, Paralegals and/or other Attorneys. Research (and lead employees who research) and determine applicable and pertinent laws, statutes, regulations, rules, and other legal authority; conducts risk analyses on key issues; relies on employees to identify and prioritize new issues. Leverage extensive knowledge to monitor and review new laws, regulations, and case law; identify and summarize relevant issues; Collaborate with other areas of L&R department; Proactively provide. Juris Doctorate and an license to practice law in the state required. 10+ years related experience required. Proficient skills/abilities/experiences in the following areas: legal knowledge, business knowledge, issue management, analytical skills, influencing others, coaching and development, self development, and productivity required. Advanced knowledge of professional standards, methods and concepts and the ability to direct functional strategy required. Computer skills, including MS Office suite, used in or related to the tasks performed required. Relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization required. Insurance-industry experience preferred. Knowledge of legal holds and discovery processes required.
