Counsel III - Privacy and Data Protection The candidate must have extensive in-depth knowledge of, and experience analyzing and applying, federal, state, and global laws and corporate policies related to privacy, especially financial privacy. Should have substantial experience drafting contacts, including: structuring, negotiating and drafting contracts involving information security, privacy, and HIPAA matters; creating and maintaining contract templates and playbooks to mitigate legal and business risk in the substantive areas listed above, and to improve the efficiency and effectiveness of legal contract support; building strong relationships with clients to ensure the contracting process generates positive client experiences and goodwill. Must have knowledge of, and practical experience with, federal and state data breach notification laws and regulations. Should have extensive knowledge and experience: Analyzing and applying laws, regulations and corporate policies related to: the Fair Credit Reporting Act (FCRA) and its application to financial institutions, privacy laws, including state privacy laws (particularly California SB1), and FCC and FTC consumer privacy rules, including TCPA and UDAAP. Assessing risk in telemarketing, email marketing, affiliate sharing, secondary use of consumer reports, credit scores, fraud scores, bankruptcy scores, and other model-based scores. Must have 5+ years of experience as a practicing attorney. Active State Bar membership is essential. Should preferably have extensive knowledge and understanding of research, counsel, and guidance on complex legal questions or inquiries. Should preferably have 5+ years of recent and continuous relevant legal experience working in a financial services law department or in the financial services practice group of a law firm. Excellent contract drafting skills, including substantial experience with contract provisions related to information security, privacy and HIPAA is an asset. Should preferably have extensive knowledge of financial privacy and credit reporting laws and standards. General knowledge of consumer and commercial deposit and lending laws, payments system laws, ecommerce laws, and residential mortgage lending laws are plus. Should preferably have experience providing guidance on privacy implications of new and emerging technologies, particularly technology related to mobile banking and mobile payments.
