Senior Privacy Counsel The candidate will interface with firm laboratories colleagues internationally and domestically on in-country and cross-border privacy and data protection-related legal issues, as well as work collaboratively to support internal business clients. Negotiating third party agreements with regards to privacy and cyber security will be one of the key focus areas of this role. Serving as the legal subject matter expert in the US region on a full range of data protection and privacy/information security matters and other applicable laws affecting the company, prospects, customers and employees. Develop, manage and assist in the implementation and maintenance of the Company's information privacy policies and procedures to ensure that business activities are consistent with them. Scoping out the privacy related needs and emerging trends for the region. Periodically revise the privacy program to reflect changes in laws, regulatory or Company policy and accreditation standards, and monitor advancements in information privacy technologies to ensure organizational adaptation and compliance, as needed. Advising on issues around collecting, sharing and accessing personal information, marketing to customers, opt-out choices, online privacy notices, policies and practices. Providing privacy-related legal advice concerning business transactions, including reviewing contracts with 3rd parties, performing privacy-related legal due diligence and drafting and negotiating applicable privacy-related provisions. Providing privacy-related legal advice regarding online and social media activities, and emerging technology. Providing privacy-related legal advice with regards to the launch of new medical devices, connected devices, mobile apps or any other technology platforms and products. Reviewing and negotiating data protection and information security terms in vendor agreements, confidentiality agreements, etc. Providing legal advice on data incidents as well as internal investigations and making determinations as to whether any notification is required to regulatory authorities. Monitoring and providing strategic legal advice concerning legislative and regulatory developments in the emerging areas of data protection and information security. Supporting the global privacy legal team in designing and delivering continuing legal education programs on privacy-related issues. Work closely with Firm product development and technology teams to anticipate potential privacy problems embedded in the use of emerging technologies (e.g. cloud, artificial intelligence, machine learning). Collaborate with and assist the Firm businesses and functions to develop corrective action plans for identified privacy compliance issues. Serve as an internal advisor to the BTS department to interpret privacy policy related questions. Work with third-party service providers and other third party stakeholders to ensure that they understand and comply with firm s basic privacy requirements. Must have Law degree, obtained with excellent results. Should have 5-7 years of privacy experience in a law firm and/or in-house corporate legal environment (in-house experience strongly preferred) with a track record of providing practical business-friendly advice. Supplementary degree is considered an asset. Strong knowledge of data protection and info security laws, rules and regulations specific to the US region, as well as industry leading-practices and standards is needed. Experience managing outside counsel and junior lawyers and comfort in working as part of virtual teams is required. CIPP accreditations is a plus.
