Litigation Affairs Counsel Duties: Companywide responsibility for supporting the internal and external preparation, prosecution, defense and/or resolution of claims arising from business units operations and ensuring all such activities are in alignment with corporate protocols as well as reporting on and maintaining records of all litigation. Responsible for supporting and overseeing the internal and external management and prosecution of contractual claims arising out of construction projects providing guidance to the company in regard to budget and strategy, and advising senior management and outside counsel as necessary. Participate in the assessment of scope and magnitude of claims and confirm that related strategies, positions and statements are in compliance with corporate policies and procedures. Manage initial investigation and categorization of claims, including insurance coverage issues, liability, compensability and damages and escalate as necessary. Identify and evaluate early dispute resolution strategies and procedures, utilizing ADR techniques and traditional dispute resolution models. Assign and act as primary liaison with outside counsel. Monitor progress of claims assigned to outside counsel, providing review and approval of budget, discovery and litigation strategy. As directed, participate in complex settlement negotiations and, in consultation with the General Counsel, recommend proactive solutions aligned with long-term view of business goals and objectives. Prepare and present executive summary reports to the Office of the General Counsel. Counsel and provide guidance to business units regarding claims and other related areas. Collaborate with Risk Management regarding contractual claims that overlap with insurance related matters.

Qualifications: JD degree with a valid law license and 10+ years experience with an emphasis on construction law, or an equivalent combination of education, training and/or experience. Self-starter, and able to prioritize multiple tasks and deliver high quality work on tight deadlines. Ability to work collaboratively with engineers, lawyers, claims adjusters and others engaged in the avoidance and resolution of claims and disputes. Proven written and verbal communication skills with emphasis on problem solving and negotiation, with ability to explain complex legal concepts to employees and staff at all levels. Proficiency with computer applications, including Microsoft Office suite, and various legal case management systems. Ability to read, understand, and interpret contracts and insurance documents. Demonstrated interpersonal skills and ability to work with staff at all levels, both internal and external.
