Director, Counsel and Privacy Compliance The candidate will report to the Assistant Vice President, Counsel and Corporate Privacy Officer. Will support the Corporate Privacy Officer in providing legal guidance for a diverse and heavily regulated company in the financial services and insurance sectors. Support the Corporate Privacy Officer in leading company's Privacy Program, with a focus on designing, institutionalizing, and maintaining enterprise-wide policies, procedures, and guidance to ensure comprehensive compliance with applicable privacy and data security laws, regulations, and inter-related company policies. Ensure company's compliance with relevant federal and state privacy law, including Health Information Portability and Accountability Act (HIPAA), the Gramm-Leach-Bliley (GLBA), the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM), the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and relevant State privacy and breach notification laws. Identify and provide counsel on a range of privacy and marketing issues related to the collection, use, sharing and protection of regulated privacy information under relevant federal and state law. Provide analysis and legal counsel related to the permissibility of new business initiatives that utilize automated phone calls, text messages, e-mails, and social media under applicable federal and state law. Provide direction, counsel and strategy for the Privacy Program, including implementation of a robust governance program that includes company policies, procedures, and guidance covering the privacy and access of customer and consumer information in accordance with international, federal and state law. Enhance privacy education and training programs and initiatives. Enhance effective systems for monitoring, auditing, and measuring the effectiveness of the Privacy Program in order to identify successes as well identifying potential areas of privacy vulnerability, risks and areas for further improvement, as well as developing a mitigation process to protect the company and its businesses and functions and ensure compliance. Develop an appropriate privacy risk identification and mitigation strategy that impacts business to protect it from non-compliance and reputational risk. Ensure the implementation, maintenance and revision of, and adherence to, the organization's policies around Protected Health Information (PHI) and, generally, other forms of regulated privacy and confidential information, as necessary to comply with federal and state laws and the company's internal privacy policies and practices. Assist in managing Privacy Leads, who have been embedded across the enterprise to operationalize the Privacy Program. Coordinate the Privacy Program with the IT security organization and related governance to confirm that all policies and processes are integrated across businesses and regions and all privacy and security issues are sufficiently addressed. Create and lead cross-functional Privacy Incident Response teams, including representatives from areas including, IT, Legal, Human Resources, Internal Audit and others. Develop internal privacy related templates, business associate agreements, external contracts and other privacy documentation for use across the businesses and regions to address privacy related issues and concerns. Continue knowledge of current privacy regulations, including contractual and operational issues involving HIPAA and other regulations and laws affecting a global diverse financial services company, and assisting businesses and regions to adapt business practices when necessary to ensure compliance. Present at internal privacy forums and town halls to enhance awareness and partnership with key stakeholders across company of the Privacy Program, as well as to ensure that the protection of privacy is embedded in company's fundamental business practices and policies. Develop external contacts and participating in professional organizations that will provide benchmarks for the Privacy Program and enhance the understanding of the external environment in order to anticipate new trends and developments in the privacy field. Perform special projects, as required.

The candidate should have a J.D. degree from a national law school with excellent academic performance demonstrated. Prior admission to at least on State Bar and admission to NY Bar within one year of hire or NY in-house limited license required. Must have 4+ years of experience in the various privacy disciplines (e.g., policy, compliance, incident response, PII inventory, information security, training and awareness, etc.) gained in any combination of a major law firm and/or corporate in-house insurance or financial services position. Experience with in-house legal and compliance functions is preferred. Should have proven experience and technical competency in privacy laws as they relate to consumer protections is required. Experience with developing and implementing privacy programs, including interaction with executives, adversaries and regulatory personnel, essential. Knowledge of privacy laws and regulations is needed. Experience drafting contracts, including business associate agreements is a must. Should have experience working with state insurance departments on privacy / data regulatory matters and/or with the Office of Civil Rights.
