Senior Counsel, Employment Law The candidate will report to the General Counsel. Will build and lead an employment law team that supports the global support office. Provide legal support and services on all employment law related issues. Represent the organization to customers, suppliers, competitors and government agencies. Provide advice with the employment law team on all facets of employment law, including employee relations issues, Fair Labor Standards Act and other federal laws, leaves of absence, termination, discipline, reasonable accommodations, retaliation, non-compete/non-solicitation agreements, reductions-in-force, unemployment, employment discrimination, unfair labor practices, and employee benefits. Supervise the investigation and response to charges of discrimination, unfair labor practices, and other complaints filed with federal, state, and local administrative agencies, including the US Equal Employment Opportunity Commission, National Labor Relations Board, US Department of Labor, and US Occupational Safety and Health Administration. Coach and support Team Member Services (HR) and regional leadership in promoting fair employment practices as part of a continuing effort to minimize employment litigation. Advises on strategies for avoidance of and defense against union activity. Leads the employment law team and provides, with the General Counsel, the employment law strategy for Whole Foods Market. Supports entire company by reviewing internal policies and procedures to ensure compliance with all federal, state, and local labor and employment laws. Works closely with TMS Communications and training staff to ensure TM awareness and understanding of any policy changes. Provide guidance and support to TMS on a host of task forces as requested (travel time, PTO, ineligible for rehire, document retention, benefits administration committee, Canadian summit, UK summit). Oversees vendor and independent contractor relationships to minimize company's liability for employment and immigration practices. Examine legal data to determine advisability of defending or prosecuting lawsuits. Track labor and employment activity on a global basis to enable trend spotting and the need for training and more effective compliance programs. Support regions by drafting position statements in response to administrative charges of discrimination as requested. Support regions by providing legal representation at administrative hearings as requested.

The candidate should have a J.D. degree from an accredited law school. Should be admitted and in good standing to the Bar of any state. Must have 10-11 years of experience in employment law. Ability to analyze and interpret legal issues and draft pleadings, motions, briefs and legal memoranda is required. Should have ability to conduct complex legal research using on-line research tools. Ability to interact and clearly state legal strategies and goals with company leadership, outside counsel adjusters, opposing counsel, vendors and claimants is needed. Should have substantial experience with delivering advice and counsel to clients such as Human Resources.
