Franchise Law Counsel The candidate will manage the discovery processes for manufacturer/dealer litigation and provide counsel on legal issues affecting the manufacturer/dealer relationship. Will manage and assist with the management of manufacturer/dealer litigation across the country. Includes supervising the matter, formulating case strategies and tactics, marshaling the company resources for prosecution of the case, and handling discovery. Oversee the franchise team s discovery processes. Prepare detailed responses to discovery requests including interrogatories, requests for production of documents and requests for admissions on behalf of Hyundai. Coordinate the preparation of document productions in response to requests for production of documents and subpoenas. Assist Internal Audit and Finance on legal issues relating to dealer incentive and warranty audit matters; manage related dealer disputes and litigation. Maintain current knowledge of and provide regular updates to National Sales and the Regions on recent developments in state dealer franchise laws, federal regulations and case law. Conduct, as needed, research into various state law franchise affairs. Prepare memoranda regarding the same. Provide counsel to National Sales and firm s Regions on legal issues affecting the manufacturer/dealer relationship, including interpretation of firm s dealer agreement, distribution, and incentive and pricing issues. Draft and/or review documents relating to market representation actions and dealer transactions with firm, including letters of intent, relocation commitment letters, default notices, termination notices, asset purchase agreements, dealer appointment notices to state agencies, dealer financial assistance requests and internal market studies.

The candidate should have Bachelor's degree. JD degree is required. Should have 4+ years of experience in business litigation. Franchise law or franchise affairs experience is preferred. Strong analytical skills, strong drafting and negotiation skills, strong oral and written communication skill is needed. A strong understanding of automotive dealer operations and network is essential. Member California State Bar Association is needed.
