Senior Counsel (Litigation Attorney) Duties: Will (i) litigate claims from inception to verdict in California, (ii) manage all litigation and make strategic litigation decisions nationwide and (iii) oversee a small litigation department. The candidate should have good credentials from a nationally accredited law school, law firm experience and in-house experience in the construction industry. Handle directly all construction defect litigation matters in the Southern California area, either defending ISI or prosecuting claims against the ISI s subcontractors and suppliers. Hire and manages outside counsel on all construction defect claims outside of Southern California. Draft legal documents, pleadings, motions, briefs and opinions and perform research related thereto, as required. Conduct necessary and appropriate discovery, attend hearings, trials, depositions, oral arguments, mediations, arbitrations and similar proceedings. Conduct settlement negotiations. Provide supervision and guidance to support litigation staff and to outside counsel. Understand and creatively uses technology to improve quality and reduce costs. Capable of working with office staff who are remotely located. Advise, communicate and confer with General Counsel rendering clear, unambiguous legal opinions and advice. Understand construction, products, engineering or similar issues and defenses involved with cases or matters. Prepare and conduct training sessions for company personnel as required. Periodic travel throughout the Southern California region is required. Interface with ISI s insurance carriers.

The candidate should have: JD Degree from accredited law school. Current membership in good standing of state bar of California. 6+ years construction litigation experience, preferably representing builders, contractors and/or subcontractors. Experience working with insurance companies is preferred. Significant experience in law and motion, taking and defending depositions of experts and percipient witnesses, making court appearances, complete file handling, and trial preparation in state, federal court and arbitration. Knowledge of California ?¢s Right to Repair Act (SB 800). Litigating additional insured and indemnity claims against subcontractors and suppliers. Ability to manage a large case load. Strong research, writing, advocacy, analytical and interpersonal skills and the ability to work in a team environment. Proficiency in drafting pleadings, motions, discovery, mediation statements and status reports. Knowledgeable in document management database and court electronic filing systems. Leadership and confidence while also being able to participate effectively and constructively as a member of a team. Ability to exercise sound judgment and to work independently and efficiently under time pressures and deadlines in a fast-paced, demanding environment. Ability to manage clients with a customer service-oriented approach. Ability to work with minimal supervision. Excellent presentation and negotiation skills.
