Assistant General Counsel - Litigation The candidate will conduct and manage firm s insured and self-insured litigation and claim responses including coordinating discovery and defense, engaging outside counsel, notifying insurance carriers, preparing litigation holds, and assisting with Company witness preparation for depositions, discovery and mediation. Will oversee and coordinate legal aspects of firm s litigation and presuit claims management processes to ensure efficient and effective resolution of cases and claims involving various substantive legal areas, including construction defect, products liability, personal injury, motor vehicle torts, employment, safety and other regulatory claims, workers compensation, insurance coverage, preferential payments, breach of contract, and various business torts. Assist and participate in responses to federal and state agencies including the EEOC s, state human rights commissions , OSHA and state safety agencies , and environmental agencies charges and citations. Advise Company department and field management and operations leaders on the interpretation of Company standards and policies, threatened claims, proper legal protocol and practices, and responsive actions. Facilitate timely responses to requests from field operations and sales teams, producing strong work product with minimal interference to field productivity. Serve as firm s acting Company representative in key mediations, settlement hearings, and negotiating settlements and release agreements. Synchronize litigation reports including preparing monthly and quarterly case and claims reports, advising on accounting reserves, and preparing exposure analyses. Successfully direct and manage potential longer-term legal projects to minimize firm s financial and business exposure. Timely respond to internal and external customer requests and inquiries. Participate in and conduct internal investigations. Manage outside legal counsel activities including negotiating fee arrangements, coordinating budgeting, and reviewing legal bills. Proactively identify and surface Company legal exposure, and determine and coordinate appropriate corrective actions. Must currently be a member in good standing of a state Bar with no history of professional discipline. Should be adept at developing strong, collaborative working relationships with internal and external clients, in-house teams, and outside counsel; strong people management skills with experience supervising paralegals and managing junior lawyers. Should be a MS Office and computer literate. Must have excellent oral and written communication skills. Must be licensed and actively practicing law as a state and federal court litigator for 5-7 years having progressive legal experience and responsibility working for a strong law firm or corporate legal department. Experience working in a public company s legal department and managing a large litigation and claims docket is a plus. Ideally, the successful candidate should have litigation experience in a variety of substantive legal areas with significant experience defending residential and light commercial construction defect litigation including related insurance coverage. Knowledge of the homebuilding industry is preferred; experience working for or representing national home builders, particularly those with operations in California and Nevada, including having a working familiarity with right to repair statutes and practice in California and Nevada, as well as other states, is preferred and a definite plus. Prior experience with electronic or cloud-based litigation, risk management, and document management systems.
