Senior Counsel, Employment The candidate will be responsible for managing the company s employment litigation throughout the United States in a manner that is cost-effective, strategic, and consistent with the organization s focus on legal compliance, risk mitigation, employee experience, and client relationships. Actively oversee and partner with outside counsel on employment litigation (when outside counsel is used on a limited and selective basis). Directly handle and represent the company in employment litigation (to include, without limitation, pleadings, discovery, motions, hearings, settlement, mediation, trial, appeal, and arbitration, if and as applicable), when outside counsel is not engaged. Handle administrative charges, agency investigations/audits, and attorney demand letters as needed. Proactively develop and drive employment litigation strategy. Conduct litigation-related root cause analysis (RCA), develop remediation recommendations, and consult on implementation. Collaborate with company executives, business leaders, and other stakeholders in connection with litigation-related risk mitigation strategy and remediation. Diligently manage litigation budget and counsel fees. Liaise and manage relationships with EPLI providers. Track, analyze, and prepare strategic reports on employment claim metrics and RCA. Must have JD degree from accredited law school and currently licensed member of at least one state bar organization in good standing. Should have 8-10 years extensive experience litigating and arbitrating state and federal employment claims on behalf of employers (including class/collective actions). Significant experience in the following in the area of employment law and employment practices: Conducting investigations; Managing and responding to administrative charges (including systemic cases); Responding to attorney demand letters; Responding to government investigations and audits. Should preferably have 2 years experience as in-house counsel including oversight of outside counsel. Expert knowledge of federal, state, and local employment law and state and federal litigation procedures is needed. Outstanding written and oral communication skills including ability to effectively communicate with outside and opposing counsel and internal clients at all levels is needed.
