Senior Litigation Counsel The candidate will manage litigation and other dispute resolution across the enterprise (with the exception of employment disputes and litigation). Will advise and counsel on pre-litigation matters; actively manage outside counsel for strategic and economic resolution of litigation matters; and provide legal advice as related to these matters. Will analyze issues, costs, and proposed resolutions; and will prepare reports, summaries, and litigation management guidance for the General Counsel, the Legal team, the Regulatory Affairs team (as appropriate) and other Company leaders and managers. Will focus on US work but will support formal and informal dispute resolution in Canada, and potentially other countries, as needs arise. Handle a broad portfolio of litigation matters across a broad spectrum of complexity and organizational risk as publicly traded companies in this industry experience and publicly report. Participate as a litigation leader and strong team player in a collaborative, growing legal and regulatory team. Advise executive management and Company leaders on the Company s litigation and risk profile. Investigate and evaluate factual circumstances at issue in disputes prior to formal litigation, engage in early matter assessment, and recommend resolution of disputes prior to litigation when appropriate. Continue to develop and enhance the Company s litigation strategy and processes (e.g. discovery and matter management) across the enterprise. Collaborate with employment counsel and their handling of employment litigation matters, reporting and processes. Work with business leaders across the enterprise to identify and manage potential litigation risks, and mitigate and resolve disputes and related risks while developing consensus (even for difficult or unpopular courses of action). Develop and provide litigation risk assessments, including definition of the scope and nature of risks, estimated costs, likelihood of successful resolution and valuation of various outcomes. Manage and conduct all phases of internal discovery support, including: litigation hold processes, e-discovery, witness preparation, etc. Influence and direct cross-functional teams as needed to support litigation or other dispute resolution. Manage outside counsel relationships, including: matter budgeting, law firm staffing, case management, and conflict waiver requests. Represent the Company in various state and federal courts or agencies in administrative proceedings. Work with outside counsel (as needed) to: draft and edit pleadings, briefs, memos, and depositions; negotiate settlement agreements; attend hearings and trials. Attend depositions, hearings, mediations, arbitrations, and settlement conferences, as needed when appropriate to advance the Company s interests. Review contracts and agreements for key issues relevant to litigation; draft and edit responses as needed. Provide focused leadership to enhance the Company s debt collection, and resolve related disputes and litigation across the enterprise. Identify recurring issues and patterns associated with litigation and other dispute matters and collaboratively create strategies to limit the Company s exposure. Other duties, potentially including management of staff, as assigned by the Company s General Counsel. Must have 10+ years experience as a litigator, including writing substantial numbers of complex motions and briefs, participating in depositions, conducting investigations, and acts of trial work from inception through mediation, arbitration and trial. Must be licensed to practice law in state and federal courts in Minnesota.
