Corporate Counsel The candidate will work with team of Attorneys and will focus on Employment and Benefits Counseling. Provide day-to-day legal advice and guidance concerning labor and employment-related issues, including workplace investigations, discrimination, harassment, and retaliation, data collection and security, drug testing, accommodations, criminal background checks, taxation, websites and social media, wages and hours, reimbursements, safety and security, attendance and leave, and employment decisions such as hiring, corrective action, suspension, and termination. Prepare and review labor and employment-related materials, including handbooks, manuals, policies and procedures, standards, posters, notices, applications, forms, acknowledgements, severance and employment agreements, training and presentations, and various communications to team members. Prepare and provide training on labor and employment-related topics, including workplace investigations, disability accommodation, criminal background checks, and Company policies and procedures. Review labor and employment-related contracts, including independent contractor, temporary staffing, third-party vendor, and franchisee agreements. Manage immigration matters such as I-9s, H-1B applications, visas, and other issues related to rights and obligations concerning employment in the United States. Coordinate with PeopleFirst to undertake lawful union avoidance efforts at Company-owned locations and assist in collective bargaining negotiations as necessary. Provide updates to PeopleFirst and other departments regarding labor and employment-related trends, legislation, regulations, ordinances, and decisions issued by courts and administrative agencies. Provide day-to-day legal advice and guidance to PeopleFirst regarding employee benefits, including compliance with federal, state, and local laws such as ERISA, ACA, HIPAA, GINA, and COBRA. Prepare and review employee benefit plan documents, summary plan descriptions, administrative agency filings, and communications. Engage outside counsel to represent the Company in litigation and monitor, direct, and assist outside counsel in all aspects of the litigation cycle, including discovery, motion practice, hearings, settlement conferences, mediations, trials, and appeals. Litigation oversight encompasses claims filed on an individual or class/collective action basis in a judicial or arbitration forum regarding labor and employment, wage and hour, contract, ADA access, patents, franchisor-franchisee issues including joint employer claims, bankruptcy, auto liability, general liability, and workers compensation. Prepare responses to labor and employment-related claims filed with federal, state, and local administrative agencies, such as the EEOC and NLRB. Oversee handling of labor and employment-related audits and investigations initiated by federal, state, and local administrative agencies, including OSHA and the federal DOL and DOT. Provide advice, counsel, contract review/drafting/negotiation support to assigned customer groups as necessary. Participate in and provide legal assistance for various special projects, including interdepartmental task forces and teams.

The candidate should have J.D. from an accredited law school, admitted to practice law in Michigan or other U.S. jurisdiction eligible for admission in Michigan within 12 months with experience in employment and benefits law. Must have 2+ years experience practicing law with experience in employment and benefits. Ability to manage multiple assignments with minimal supervision and in a timely manner is required. Should have excellent interpersonal and problem-solving skills and abilities. Must have excellent written, verbal, presentation and communication skills.
