Senior Associate Counsel -Torts & Litigation Responsibilities: Represent Metro-North and other agencies in various matters involving litigation in State and Federal Courts. Represent Metro-North Railroad in the vertical defense of personal injury causes of action; including asbestos, toxic tort and cumulative trauma. Represent Metro-North in claims related to the FRSA and other labor related issues. Defend personal injury lawsuits on vertical basis; investigations, public authority hearings; pleadings; depositions; motion practice; trials. Represent Metro-North Railroad and other agencies at trials; appeals; mediations; settlement and Court conferences. Represent Metro-North and other agencies as an affirmative claimant or as a defendant in matters related to personal injury litigation. Coordinate legal strategy with and provide legal advice to various Authority agencies and other departments. Defend Metro-North in matters related to the FRSA and other labor related issues. Recruit and supervise law fellows and law interns for the Legal Department. Provide legal advice to internal departments such as Claims Services, General Counsel and Safety regarding State and Federal regulations applicable to Metro-North and/or other agencies.

Qualifications: JD Degree from an accredited law school. Admission in Good Standing to the New York State Bar. 8+ years of trial experience in civil and/or criminal cases with demonstrated ability in all phases of vertical representation. Must have participated in a significant manner, as lead counsel or assisting lead counsel, in at least 5 trials. Superior trial skills. Strong commitment to the public service. Ability to handle a high volume, varied caseloads and function independently and under pressure, often under tight time constraints imposed internally or by the Courts. Proven ability to effectively defend/prosecute on a vertical basis from pre-suit investigation through trial and appeal. Proven ability to successfully conduct trials in both Federal and State Courts related to various types of claims involving Metro-North including but not limited to FELA matters, general negligence matters, and matters involving Metro-North s relationship to other agencies and to outside parties. Experience handling high exposure causes of action. Proven ability to manage and prioritize varied workload. Proven ability to communicate effectively and persuasively both verbally and in writing. Proven ability and great command over all types of research including but not limited to legal research engines (Lexis and Westlaw), general internet searches and investigative searches. Proven strong analytical skills. Proven ability to forensically analyze medical records and varied technical information. Ability to supervise staff, law fellows and legal interns. Ability to successfully negotiate settlements at mediations both in the Federal and State Courts and with third-party mediators. Experience advising management in pre-litigation negotiations and settlements. Proficiency in Microsoft PC applications and/or comparable applications. Preferred Education/Experience: Ability to draft and argue Appeals to both State and Federal higher courts. Experience with commercial matters including construction law cases both in litigation and with respect to regulatory matters. Experience in matters related to real estate conflicts litigation. Experience both in litigating real estate/commercial conflicts and in overseeing outside counsel. Experience with litigating and defending matters related to labor conflicts such as FRSA claims, retaliation claims, discrimination claims and/or interference with treatment claims. Familiarity with Adobe 7 and Needles systems. Experience in Federal court and appellate court.
