Director, Privacy Counsel The candidate will provide legal advice regarding privacy matters as the principal subject matter expert on privacy law and technology risk management issues for the Americas region. Analyze new or pending legislation for impact on the business and any potential modifications to business practices. Provide direction on the implementation of new privacy and security laws and regulations. Proactively identify compliance and regulatory issues affecting the company s compliance with privacy laws and regulations. Conduct privacy due diligence reviews, privacy impact assessments, and integration plans for potential acquisitions and partnerships. Draft and negotiate, and guide others to draft and negotiate, privacy provisions in contracts, and internal and external documents, filings, policies, and operating procedures. Partner with business units to help drive a culture of risk awareness and proactive risk identification and assessment. Collaborate with the Chief Information Security Officer and regional InfoSec team members to ensure the proper oversight of security and incident response matters, including response to potential security and data incidents. Support the regional human resources department on employee privacy matters. Handle regional regulatory inquiries, privacy complaints, and data subject requests. Report key performance indicators and other department metrics. Actively manage regional Privacy and Incident Management programs. Support the day-to-day privacy duties of the Americas region as part of the Global Privacy Department s leadership team. Develop innovative practices that comply with legal and regulatory requirements as well as serve strategic business needs. Provide leadership on enhancing and implementing a global privacy framework that works well within a matrixed organization by incorporating global level policies, standards, controls and operational procedures. Work closely with IT, HR, Operations, and Compliance organizations to enable privacy activities and integration into their structures, processes and governance. Provide effective leadership, management and implementation support to global privacy program effectiveness, privacy risk mitigation strategies and core technical capabilities. Educate all Western Union teams within the Americas region on the privacy framework and its components through training, awareness and communication activities. Develop and oversee regional privacy and data governance standard operating procedures. Provide guidance to business partners on requirements for data protection associated with current and future business strategies, including to the marketing, AML, Risk, Operations and HR departments. Excellent verbal and written communication skills, including confident presentation skills are needed. Excellent organizational and prioritization skill is needed. Microsoft Office skills, particularly Word and PowerPoint are desirable. Law degree from ABA accredited law school is needed. Must be admitted to practice law in at least one state. Significant privacy-related work experience as in-house counsel or at a law firm advising on privacy (6-9 years) is needed. Strong knowledge of privacy laws and regulations in the Americas, including US Federal privacy and State data breach laws is essential. Canadian Federal and Provincial laws; and privacy laws in Mexico, and Central and South America is needed. Technology knowledge or experience a big plus. CIPP Certification is preferred.
