Senior Counsel - Intellectual Property Responsibilities: Works directly or with his/her direct reports to support assigned R&D groups and conduct preliminary patent searches through various patent databases, identify potentially patentable subject matter, draft and prosecute patent applications as well as work with outside counsel to support these activities, and perform Freedom to Operate analysis and related client counseling for assigned R&D groups. Works with IP Team to provide competitive intelligence and pro-active IP strategy counseling to assigned R&D groups. Directly advises assigned R&D groups with respect to IP-related contracts, including for example, confidentiality, consulting and research agreements, joint development agreements, etc. Manages and provides counseling on trade secret and confidentiality-related matters for assigned R&D groups. Works directly or with direct reports to provide IP-related advice and support for transactions and client counseling. Advises regarding intellectual property aspects of licensing, M&A and commercial activities as assigned by Associate General Counsel IP. Manages litigation-related activities as assigned by Associate General Counsel IP. Develops and provides IP training for innovation groups and business and commercial operations as assigned. Qualifications: Law Degree and admitted to practice in at least 1 jurisdiction. Admitted to USPTO Bar. 12 + years experience on the area of intellectual property and contract law. Clear ability to manage and develop direct reports and other team members. Strong knowledge of R&D and legal organization and good working relations with same. Demonstrated ability to solve problems efficiently, directly and pragmatically. Demonstrated oral and written ability to concisely and simply communicate complex legal issues. Demonstrated ability to think and act globally and strategically, and to appreciate regional interests while doing so. Expert knowledge of global legal concepts applicable to intellectual property matters Specific knowledge of key local country laws applicable to intellectual property matters Significant experience in negotiating and drafting agreements and establishing external relationships Significant experience in the development and management of intellectual property Knowledge of Law Department practices, procedures and policies Knowledge of internal R&D and business policies, procedures and practices Knowledge of external innovation practices Authoritative and assertive with excellent motivation and communication skills to handle and develop key relationships and skillfully extract value from them. Strong interpersonal skills and proven track record in managing and influencing internal client relationships Sensitivity to cultural and local issues, ability to work easily in a multi-cultural environment. Comfortable presenting to large and diverse groups at all levels within the business Clear leadership and associate coaching, management and development skills with ability to capture, enthuse, and motivate a working team and demonstrate high performing team attributes Comfortable with shifting gears, can make decisions under uncertainty Comfortable being the champion of unpopular position that represents the best interests of the business. High level interpersonal, oral and written communication skills required Ability to envision multiple possibilities, can craft approaches likely to be seen as positive Ability to think globally, acting locally. Relates well with different nationalities and cultures Ability to interact with all levels within Mars Wrigley Confectionery, and Mars, Incorporated and maneuver through complex political situations internally and externally Very high level of attention to detail. Strong analytical and planning skills. Must be a self-starter, highly motivated with a bias for action (strong work ethic) and able to function independently in a hands-on environment. Strong, flexible team player that works to meet both personal and organization goals. Excellent organization and execution skills. Consistently demonstrates persistence and conscientiousness. Consistently demonstrates common sense and judgment. Ability to multi-task. Commitment and willingness to work long hours when required. Ability to travel when required.
