Intellectual Property Litigation Attorney The candidate will litigate disputes in close partnership with outside counsel, in-house attorneys and internal legal and business teams. Develop comprehensive, sound litigation strategies and plans, including independently formulating and driving short- and long-term milestones for successful resolution. Provide pragmatic, trusted advice to business stakeholders and senior leadership on litigation risk and mitigation opportunities. Manage and/or directly carry out all intellectual property litigation tasks with little supervision by stakeholders, including developing overall case strategy; drafting pleadings, motions, briefs, discovery requests and responses, internal memos and expert reports; interviewing fact and expert witness; internal document collection and production, including working with the internal e-discovery team; preparing witnesses for depositions and taking and defending depositions; preparing infringement and invalidity contentions; developing claim construction positions and arguments; attending court proceedings; and negotiating settlement and drafting settlement agreements. Conduct internal investigations and defend against third party audits. Support IP department initiatives, IP diligence, and education programs. Must have 6-8 years of complex commercial litigation experience including 3-4 years of patent litigation at a major law firm and/or in-house legal department. A solid record of litigation experience within the life science or biotechnology industries, some familiarity with Hatch-Waxman litigation, and comprehensive understanding of U.S. and European patent law and practices are preferred. Membership in good standing with the California State Bar (or member in good standing of another state bar and eligible for RIHC status in California) is required.
