Litigation Counsel The candidate will perform top caliber work on legal issues primarily relating to premises and other liability claims and lawsuits, as well contract and other commercial disputes, to fill the position of Litigation Counsel. Will handle pre-suit claim investigation and litigation from inception to conclusion, including gathering of necessary evidence and hands on direct management of internal claim adjusters and outside counsel. While the primary role will be claim and litigation management, will also work with Director of Risk Management on contractual risk management program and will be responsible to promptly and professionally respond to inquiries regarding insurance and indemnification contractual provisions. Review and analyze claim documentation and legal filings. Work with and manage in-house adjusting staff responsible for all pre-litigation claims. Oversee all stages of litigations in a hands-on capacity, including design strategy, construct arguments, gathering, reviewing and analyzing claim documentation and legal filings, preparing witnesses for depositions, directing and managing outside defense counsel. Strategize and maximize early settlement opportunities. Attend mediations and/or settlement conferences. Continually assess exposures and adequacy of claim reserves, and escalate high exposure and/or volatile claims to management. Liaise directly on daily basis with relevant company employees and with senior management. Maintain timely and accurate file documentation/information in claims/litigation management system. Work with Director of Risk Management on tenant and third-party vendor insurance and indemnity program requirements, and enhance risk management, including risk assessment and mitigation. Counsel co-workers regarding litigation exposure and risk and develop strategies for litigation prevention. Smartly manage and track third-party vendor and service provider spend. Keep up-to-date on relevant business industry, insurance and indemnity related laws and regulations to identify change and incorporate into policies, procedures, and transactions. Exercise primary responsibility for the implementation of legal holds, document preservation and e-discovery initiatives, as necessary. Respond to subpoenas and other requests for documents. Perform additional tasks as requested by the General Counsel and senior management, and provide other legal advice and services as the needs of the organization arise, including contract review, negotiation and drafting.

The candidate should have a J.D. degree from an ABA-accredited law school. Bar admission in good standing and ability to obtain Florida House Counsel status is required. Must have 5-7 years of professional experience in the areas of general liability/bodily injury law defense work at a top rated law firm. Detailed knowledge of New York Labor Law, including Section 240, etc. is required. Detailed knowledge of indemnity law is needed. General knowledge of insurance coverage law is essential.
