Associate Compliance Counsel, The candidate is responsible for assisting in the planning, designing, and implementing the Compliance and Privacy Program. Understands hospital guidelines, applicable laws and regulations and partners with management and Senior Leader to provide continual risk assessment, development of comprehensive policies and procedures, compliance training, protocols, internal investigations, providing regulatory reviews and opinions and auditing and monitoring. As the Vice Chairperson of the Hospital Ethics and Compliance Committee, oversees the organizational process to ensure adequate regulatory process and policy development and dissemination to comply with regulatory requirements. Coordinates the development, maintenance, implementation, and revision of policies, process and procedures and other documents for the operation of the compliance program. Develops compliance training materials and performs compliance training throughout MCHS under the direction of the Leader. Ensures reported issues and/or concerns are identified, investigated, and resolved. Develops corrective action plans as appropriate. Monitors the day to day compliance activities of MCHS and maintains the electronic tracking system for compliance matters. Analyzes statistical data and reports to identify and determine compliance issues. Performs compliance audits for the purpose of monitoring processes and detecting noncompliance, including coordinating audit activities and responses with external counsel as needed. Prepares audit reports and makes recommendations to the Leader and management based on findings. Prepares periodic reports for management and the Audit and Compliance Committee of the Board of Directors. Regularly assesses the Compliance Program, performs compliance risk assessments and recommends appropriate actions as necessary. Develops and implements MCHS's compliance work plans and assist Leader in establishing and maintaining departmental goals and objectives. Performs legal/regulatory research and drafts legal memoranda as needed. Reviews and updates MCHS's Code of Conduct, compliance and hospital policies, contracts and other compliance related materials to ensure it is current and relevant with all applicable federal, state, and industry laws, regulations, and standards in providing guidance to management and employees. Serves as a contact person for reports of concerns or potential compliance issues. Confers with management staff to identify and correct potential areas of noncompliance and anticipate future compliance requirements. Brings all reported issues to the attention of the Leader. Provides advice and counsel to hospital leadership and hospital departments regarding federal and state regulations and carrying out polices in accordance with those regulations. Serves as a Vice-Chair of the Hospital Ethics and Compliance Committee and assist hospital leadership with bioethics issues including regulatory and statutory framework for bioethical decision making. Law Degree from an accredited US law school is essential. Must have 4+ years of experience as a practicing attorney, private practice or in-house experience in health care law and/or compliance. certification required within a year in position is essential. Licensed attorney in a U.S. jurisdiction is essential. Florida Bar preferred. Excellent computer, office automation and word processing skills is essential. Excellent communication skills both verbally and in writing is essential.
