Associate General Counsel, Intellectual Property The candidate will report to the Head of Legal at firm. Will be building out and leading a small team of patent attorneys to support patent prosecution efforts at firm, serving as a member of the legal leadership team and as the IP representative on other cross-functional teams at firm; developing and implementing strategy for a global patent portfolio in immunology and cell therapy areas; conducting and directing freedom-to-operate and patentability assessments; reviewing and negotiating the IP provisions in various agreements;providing IP support to a broad range of groups including R&D, Manufacturing, Tech Ops, Alliance Management and Corporate Development; creating and maintaining a reasonable budget for internal and outside counsel spend; and managing outside counsel and working collaboratively with the legal department and cross-functional groups at Gileads headquarters in Foster City, CA and at affiliates and subsidiaries around the globe. Draft and prosecute patent applications (US and foreign patent offices). Develop and maintain a detailed understanding of assigned projects. Conduct patentability and freedom-to-operate reviews. Counsel research scientists and other colleagues regarding patent portfolio and strategy. Review and assist in the drafting of nondisclosure, research, license and other agreements involving the use, transfer, or ownership of intellectual property. Review proposed publications in regards of potential invention disclosure. Provide support for licensing deals, collaborations and acquisitions. Create and manage a budget for internal and external counsel spend.L ead and mentor junior attorneys, paralegals, patent agents and informatics specialists. Advise senior executives efficiently and effectively on complex IP issues.

The candidate must have Juris Doctorate degree and admission before a State bar or fully qualified legal credentials in geography of operations. Must have years of experience as a Patent Agent may be substituted if currently pursuing Juris Doctorate degree. Must have 10 years of industry and/or law firm experience. Fully admitted to practice applicable laws in the country or jurisdictions of responsibility is essential. Must have excellent written and verbal communications skills. Must have strong client service orientation is essential. Experience in the biotechnology or pharmaceutical industries preferred. Prior management experience preferred. Advanced degree in Molecular Biology, Cell Biology, Immunology, Life Science or related sciences preferred. Registered before the USPTO is essential. Significant experience with patent litigation and trademark work is preferred. Some exposure in these areasis helpful.
