Corporate Counsel, Regulatory Duties: Regularly monitor and analyze Health & Human Services ( HHS ) rulemaking related to value-based reimbursement, alternative payment models, health IT certification, information blocking and interoperability. Educate and provide legal advice to relevant company departments such as Compliance, Regulatory Affairs, Product Development, Product Management, and Interoperability Services on regulatory and legislative initiatives impacting product strategy, corporate compliance, and/or certification status. Coordinate with Quality, Compliance and Product Management to assess the impact of product upgrades, updates, and defects on certification and Greenways ability to support customers reporting on government and private-payer quality EHR programs and compliance with the False Claims Act, Anti-Kickback Statute, and 21st Century Cures. Provide legal advice on the impact of regulatory requirements in disputes with customers, partners, certifying bodies, patients, or government agencies such as the Office of the National Coordinator for Health IT (ONC), the Centers for Medicare & Medicaid Services (CMS), Office of Inspector General (OIG) and state Medicaid agencies. Disputes include ONC and ONC-ACB surveillance actions, information blocking allegations investigated by the OIG, and civil actions. Educate customers on recent and proposed rulemaking related to programs supported by Greenways products, such as:. MIPS. Advanced APMs. Comprehensive Primary Care Plus+. Medicare Shared Savings Program. Accountable Care Organizations (ACOs). Patient-Centered Medical Home (PCMH). Medicaid Managed Care. Medicaid Promoting Interoperability. Chronic Care Management (CCM) services. Transitional Care Management (TCM) services. Annual Wellness Visits. Draft Company and industry position papers regarding proposed regulations. Actively engage health IT industry associations such as the Healthcare Information and Management Systems Society (HIMSS) and the Electronic Health Record Association (EHRA) as a thought leader, including participating in industry events as a speaker and influencer. Draft policies and procedures to assist the Company in adhering to regulatory requirements and training on same. Review customer and vendor contracts for ONC certification and other regulatory compliance. Develop collateral such as policy papers, webinars, and presentations for both internal and external consumption. Perform other duties, tasks and projects as assigned.

Qualifications: JD Degree required. FL Bar or FL House Counsel qualifications. 5+ years experience in health care regulatory, government relations and/or public policy. Experience in both healthcare and health information technology industries a significant plus. Manager experience preferred. Combination of law firm and in-house experience preferred. Ability to absorb and decipher potential impact of complex and lengthy federal agency and legislative documents and relay information in a timely, clear and concise manner. Ability to work effectively with all levels of government (federal, state, local), industry organizations, chambers of commerce and other organizations. Knowledge of healthcare delivery and health information technology industries. A solution-driven leader with a proven ability to take ownership of a variety of projects with little oversight and supervision. Strong communication (both verbal and written), diplomacy, and the ability to establish credibility necessary to effectively influence company employees and executives. Will be a transparent and collaborative leader comfortable spearheading and supporting change in a complex environment. Willingness to be flexible and adaptive and demonstrate a desire to operate in a dynamic and high-growth environment. Must possess high integrity,. Creative problem solver who possesses sound business judgment and is detail oriented. Strong quantitative and qualitative analytical skills. Outstanding strategic planning and management skills. Ability to integrate and balance priorities, work activities and resources for the benefit of multiple key stakeholders. Ability to work in a fast-paced working environment. Ability to exercise discretion and make independent judgment regarding significant department managerial, business workflow, and legal matters. Excellent attention to detail and organization skills with the ability to manage multiple priorities. Demonstrated PC skills, proficient with Microsoft Windows applications.
