Litigation Attorney The candidate will be responsible for all company litigation and threatened litigation from inception to trial, as well as day-to-day case management. Analyzes proposed and established legislation, prepares legal documents, and reviews company policies. Advises in all issues relating to employment law, discrimination, diversity and equal employment opportunity. Provides counsel and advice relating to all areas of the law impacting company operations. Responds to EEOC charges of discrimination including client contact, investigation, preparing position statements, conducting onsite visits, client interviews, mediating case with the EEOC. Oversees the workers compensation and general liability program in conjunction with the third-party adjuster, and participates in legal strategy for litigated claims, settlement decisions, and quarterly claims reviews. Manages external counsel and general litigation. Identifies risks and proposes alternative structures to mitigate risks involved in potential transactions. Creates litigation reports and correspondence, and effectively presents information to senior management. Responds to inquiries from regulatory agencies, including but not limited to, OSHA, various state health departments, various state taxing authorities, state human rights commissions, and the NLRB. Reviews and oversees the production of documents requested via subpoenas and other requests for production. Oversees compliance with lawful garnishments of wages. Manages franchisee litigation, including lawsuits brought by franchisees and lawsuits against franchises, as well as lawsuits in which the company and a franchisee are both named as defendants. Works with the insurance broker to provide information for insurance applications and make insurance claims where appropriate.

The candidate must have Juris Doctorate degree. Should have 5+ years of related experience. Highly refined, demonstrated leadership of legal matters is required. Should have ability to create new and innovative solutions in response to changes in the industry, strategic objectives of the company, or market opportunities. Must have proven analytical skills to understand complex contracts and other documents. Must have excellent analytical skills with the ability to think independently, take corrective action, and to resolve inquiries and requests for information. Should have outstanding organizational skills with ability to handle multiple priorities, meet demanding deadlines, adjust to sudden changes in workflow, and maintain high quality standards.
