Senior Counsel - Litigation The candidate will be responsible for managing a broad range of threatened and pending litigation, arbitration, and regulatory matters. Will be advising business partners (fixed and variable annuities, life insurance, and broker-dealer lines of business) concerning legal and regulatory issues and associated risks, and providing counsel on legal and regulatory requirements, corporate policies and procedures, best practices, and strategies for managing risk. Reviewing, evaluating, and managing threatened or pending litigation; assigning matters to outside counsel, as necessary, and managing outside counsel; developing strategy and budgets for efficient and effective case handling and resolution; and coordinating with business partners and outside counsel to resolve litigation matters and customer complaints. Reviewing, evaluating, and managing regulatory matters; assigning, working with, and managing outside counsel, as necessary; providing legal advice regarding state regulatory inquiries, examinations, and audits; and interacting with internal business partners (Compliance, Suitability, Operations, Distribution, etc.), outside counsel, and regulators in developing and implementing appropriate strategies and/or responses. Identifying potential legal or regulatory issues that may impact firm's Life business strategy, products or business conduct and providing expert legal advice accordingly; and educating business partners on proactive measures and approaches to reducing potential legal exposure. Collaborating with other attorneys in the department and reporting as needed concerning the progress of projects; and reporting regularly on litigation and regulatory matters and trends.

The candidate must have 10+ years experience. Must have Law firm and/or in-house life insurance company litigation management, including extensive hands-on litigation, mediation/negotiation, and trial/arbitration experience and experience managing paralegals and administrative assistants. Advanced degree required: Law degree from ABA accredited law school. Must be Licensed to practice law in Minnesota, in good standing. Must have excellent written and verbal communication skills; ability to build trust with business partners; advanced ability to analyze complex problems and to describe the analysis, options, and related recommendations in a complete yet concise manner which is readily understood by business partners. Must have strong negotiation, advocacy, analytical, organizational, speaking and presenting skills. Law firm and/or in-house life insurance company, governmental, and/or administrative agency experience handling complex state and federal regulatory matters in the life insurance and annuity industry is preferred. Substantial experience interacting with regulators on a variety of insurance matters, including state insurance inquiries, market conduct examinations, and regulatory administrative proceedings, negotiations, and settlements is preferred.
