Senior Corporate Counsel - Labor and Employment The candidate will provide legal services and counsel to AGC America and its subsidiaries, divisions, and related company entities. Serve as primary legal liaison to Human Resources ( HR ) and provide support on all labor and employment matters in the U.S., Canada, and Mexico. Provide advice and counsel to management and HR professionals on all aspects of day-to-day employment-related matters, including hiring and termination issues, discrimination, harassment, retaliation, reasonable accommodations, leaves of absence, wage and hour issues, restrictive covenants and their enforcement, and employee investigations. Investigate and represent the company at the federal and state administrative level (EEOC, DOL, OSHA, and state and local agencies). Prepare position statements and responses to inquiries/audits/investigations. Represent AGC in mediations and negotiate settlement agreements. Review involuntary terminations and draft separation packages. Develop, provide, and deliver proactive training to HR professionals and business leaders on a wide variety of employment law matters. Regularly advise HR professionals on leave management, ADA, FMLA, FLSA, FCRA, Title VII, ADEA, USERRA, NLRA, and other labor and employment legal obligations. Research and advise business leaders on emerging legislative and regulatory changes affecting AGCs employment and labor obligations. Partner with business teams on immigration matters related to AGC employees. Assist in the drafting, implementation and enforcement of internal policies and procedures related to HR issues to ensure compliance with all domestic and international laws, regulations, and legal standards. Provide legal guidance and support on pension/401k/ medical benefit plans (ERISA), and other compensation and benefits matters. Provide legal guidance and support on workers compensations matters, and serve as a key resource to drive strategy, settlement and overall reduction of program expenses. Assist with Labor Union negotiations and the management/resolution of grievances. Handle and prioritize a high and diverse volume of contractual and other legal matters with limited to no supervision as requested. Knowledge and experience with state and federal privacy laws preferred. Bachelors degree from an accredited college or university required. Juris Doctor from an accredited law school required. Licensed member of the bar, in good standing, in one or more U.S. jurisdictions required. Should have 6+ years of related and relevant in-house experience. Must have 10+ years of related and relevant overall legal experience preferred, including experience working in a law firm. Must possess strong written and oral communication skills. Must provide strategic high-level legal counsel as a partner to senior business leaders and HR professionals.
