Managing Counsel, Privacy and Cybersecurity Duties: Research, monitor and analyze federal and 50 state laws and regulations and advise business units of compliance requirements related to and the degree of risk associated with current and proposed business initiatives in the following areas: consumer consents, Foreign Corrupt Practices Act, fraud/identity theft, data sharing among affiliates, TCPA and do not call list compliance, information security and data breach/cybersecurity, privacy (including but not limited to GLBA, NYCRR and CCPA), enterprise data management (EDM), remarketing, social media, digital delivery of products and services, OFAC and fraud/money laundering. Partner with government affairs group on legislative and policy matters in the above areas. Evaluate and provide tactical and strategic advice regarding compliance and risk mitigation. Represent Legal Department in cross-functional teams formed to implement new business legal and compliance initiatives. Closely partner with Enterprise Compliance in areas of responsibility. Communicate legal opinions and recommendations simply, effectively, persuasively and professionally in writing, meetings and telephone calls. Supervise legal assistant and administrative staff in the performance of team members duties and in support of team members work. Qualifications: JD Degree from an A.B.A.-accredited law school. Have admission to any U.S. state bar and able to obtain license to practice law in Texas. Extensive years of experience as an attorney providing operations, legal and regulatory advice to lenders (preferably some portion of that time advising captive or other automotive finance lenders or companies). Work collaboratively with team, including other members of the Legal Department, Enterprise Compliance and business units. Strong drafting, oral and written communication skills. Strong customer focus and interpersonal skills. Strong analytical, organizational and process-development skills. Strong sense of inclusion and teamwork. Added bonus if have: Advising clients with multi-state or nationwide business, as well as clients regulated by the Consumer Financial Protection Bureau. Advising on legal issues related to technology driven projects. Advising on bitcoin and other blockchain technologies. In private practice and as in-house counsel. Using Complisource, CarLaw, CCH and Lexis/Nexis.
