Senior Counsel - Insurance Products Tax and Employee Benefits Tax The candidate will be responsible for the tax aspects of various company sponsored products in the Group and Global Employee Benefits markets. Will provide legal guidance on the tax and ERISA aspects of new or proposed products. Provide tax and ERISA guidance and review for all aspects of product operations, including answers to customer questions and advice on administrative or operational errors. Proper administration of the products from a tax perspective, including: drafting forms and disclosures (e.g., death claim forms, re-characterization request forms, withdrawal forms, etc.); drafting written procedures; resolving administrative errors, resolving various customer issues; and complaints. Administration of ex-patriate health and welfare insurance for client relationship managers. Compliance and consulting services for procedures related to the administration of the products; resolving customer complaints; error correction and exception requests. Communications and other sales material submissions related to annuities. ERISA and tax related matters on pension plan investment matters. Employment tax related compliance matters, including the determination of taxation of compensation, fringe benefits and payroll related items. Legislation affecting employee benefits taxation and outline same for legal department and internal business partners to ascertain the impact to the internal company sponsored employee benefit plans and the impact to the products offered to the customers. Various employment tax controversy matters, including federal, state and local audits. Employment tax related notices from federal, state and local taxing authorities. Development of training materials for internal business partners for administering the internal employee benefit plans and customer products, such as ERISA, HIPAA and ACA. Responding to ERISA inquiries from internal client relationship matters on Form 5500, Schedule A reporting. Preparation of restated plan documents related to products sold to customers. Tax aspects of designing and administering: Critical illness, Accelerated Death Benefit riders, Hospital Indemnity Insurance, and Long Term Care regarding the tax aspects of administering the remaining block of LTC business.

The candidate should have a JD degree. Admission to a State Bar Association is essential. Should have 7+ years of experience working on U.S. tax and ERISA issues in the employee benefits area for a large employer and/or in an internal employee benefits/legal capacity for an insurance company or a financial services company.
