Labor And Employment Attorney The candidate will have expertise and experience representing clients on a broad range of federal and state employment and workforce matters. Will be able to consult on the legal issues and implications of developments in the law, adversarial proceedings, business initiatives and workplace decisions. Will report to the General Counsel but will be a strategic partner to the Human Resources Department. Specific tasks include: representing the company before the EEOC and state equal rights agencies; managing all employment-related litigation and arbitration proceedings in which the company is a party, including investigating and understanding underlying facts and developing defense strategies; becoming expert in the company's mandatory Employment Arbitration Program, responding to claim notices under the EAP, and keeping abreast of developments in the law regarding the enforceability of arbitration agreements; assessing the merits of adversarial matters and advising on the wisdom and feasibility of settlement; partnering with other business leaders as necessary to respond to OSHA inquiries, ADA concerns, leave requests; advising the company's Human Resources Department on issues and laws involving the FLSA and state wage and hour statutes, benefits, leave of absence requests, accommodation requests, unemployment issues, employee discipline and termination decisions, employee training programs and compliance initiatives; drafting Associate Handbook revisions; interacting with the company's employment practices liability carrier, including the submission of claims and, if applicable, assignment of counsel; and leading the company's response in interactions, inquiries or audits initiated by federal or state departments of labor. Additional responsibilities will include counseling and assisting the company on matters beyond traditional employment law, such as worker's compensation, labor and organizing matters, risk management, complex litigation, consumer matters, and general organizational compliance. Must have a J.D. degree, law firm employment law experience, and 5+ years of experience representing clients on a broad range of employment and other workforce issues. Hands-on, practical experience is essential.
