Counsel The candidate will advise and analyze issues arising from various underwriting, originating, and servicing arrangements related to a large portfolio of loans including, without limitation, licensing requirements for brokers, originators, services, and collectors in 26 states. Draft, review, and revise (as necessary) consumer facing finance agreements, mortgages, promissory notes, servicing agreements and retail installment sales contracts for use in at least 26 states. Track, analyze and provide guidance on new and changing state, federal, international laws related to real estate, sales, finance, mortgage, and licensing to manage and minimize impact to WDIVO s business operations including, without limitation, working with trade organizations and lobbyist when appropriate. Miscellaneous title, underwriting and other matters. Juris Doctorate degree from accredited law school. LLM or Certification in Banking and/or Financial Services, preferred. Admitted to Bar Association in at least one state (need not be Florida). Must have good working knowledge of state, federal laws and regulations related to consumer finance, collections, underwriting, mortgages, lending, consumer protection, and real estate related laws, regulations, and industry best practices. Must have a good working knowledge of the federal regulations related to consumer financial services, such as UDAAP, FDCPA, FCRA, TCPA, TILA, RESPA, TRID, ECOA, EFTA, NACHA, and E-Sign Act. Must have a sound understanding of various state regulations related to consumer financial services, such as licensing requirements, collections, and consumer protection. Strong analytical, writing and negotiation skills. General corporate/commercial experience Experience working for a financial services, lending, collections, or banking company, preferred. Experience working with a publicly traded company, a plus. Experience working with condominium and timeshares, a plus. Ability to work well in a team environment yet work independently and autonomously with limited supervision. Ability to interact with all levels of management, including c-suite executives. Demonstrated ability to work under pressure.High attention to detail. Flexible in managing changing priorities and coordinating multiple projects and diverse responsibilities. Must have knowledge of Microsoft Office Products. Proficiency in legal research, including applications, the Web and other sources. 3 years of legal experience focused primarily on consumer financial services, preferably with a consumer finance company or mortgage lender.
