Privacy Corporate Counsel

Privacy Corporate Counsel The candidate will focus on privacy and compliance issues, primarily focusing on US and Canadian privacy issues, data protection, security, advertising and consumer protection laws and regulations. Will support company's various business segments on a broad range of commercial transactions, with a heavy emphasis on identifying and proactively addressing privacy issues. Will have extensive knowledge about current and emerging consumer privacy laws and experience negotiating a variety of commercial contracts. 6 years of experience, preferably working with a public company or a mid to large sized law firm are required. Licensed to practice law in good standing in at least one state, preferably Ohio or New York are required. Completion of a Juris Doctor or equivalent are required. IAPP Privacy Certification such as CIPP or CIPM preferred. Experience with privacy issues facing retailers preferred. Experience with developing and implementing a general privacy compliance program preferred. Advise on privacy, regulatory and compliance matters, advertising guidelines, consumer-facing disclaimers, website terms of use, data protection and retention, data security, data breach rules and privacy policies. Serve as the primary legal partner for supporting the business initiatives of the Chief Information Officer and Chief Marketing Officer by providing proactive, practical commercial advice. Draft and negotiate commercial transactions including significant service agreements, master service agreements, software licensing and development agreements, marketing, e-commerce, strategic alliances and/or joint venture agreements, professional and hosted services, market research and technology and marketing contracts. Provide strategic support managing litigation related to privacy and data security issues. Assist in continued development and improvement of all aspects of privacy programs (data handling standards, privacy policies, associate training). Collaborates with other members of the legal team and other cross functional partners to analyze and assist with pertinent privacy and data security aspects of company's business initiatives. Oversees the investigation of potential privacy incidents, complaints or breaches, including notifications and other resolution efforts. Demonstrate strong understanding of current and emerging privacy and data security laws, and demonstrate ability to translate knowledge to deliver relevant, proactive and actionable guidance to business partners in areas such as IT and marketing are required. Possess strong substantive knowledge of legal and self-regulatory privacy and data requirements globally (primarily North America) such as CCPA, PCI-DSS, Mobile Application Privacy Codes of Conduct, State Breach Notification and Data Protection Laws, FTC Act, TCPA & TSR, CAN-SPAM, COPPA, PIPEDA, FACTA and various state privacy laws and industry regulations are required. Demonstrate strategic thinking skills needed to architect any new processes and/or programs to address emerging privacy laws. Also demonstrate leadership skills needed to influence key stakeholders to insure implementation buy-in are required. Understand the technologies that create privacy and data security challenges and keep current on legislative, judicial and regulatory privacy and data security developments in order to understand and communicate the effect of such developments on company's business are required.
