Senior Corporate Counsel (Environmental Litigation) The candidate will manage a diverse docket of matters including CERCLA, property damage, negligence, nuisance, toxic tort, trespass, indemnity, insurance coverage, and related claims and litigation. Will provide legal and professional support to relevant Company functions, including Engineering & Environmental Compliance, Sustainability, and Post Collections Operations Support, with respect to environmental and regulatory requirements, compliance and disclosures, investigations, remedial and Superfund projects, transaction diligence, policies and procedures, training, and other matters. Provides legal and professional support to the Companys Risk Management team on environmental/pollution claims investigation and management, insurance policies, and other matters. Exercises deep knowledge of federal, state, and local environmental statutes and regulations, and advise on major environmental statutes and regulations, including: The Solid Waste Disposal Act, including the Resource Conservation and Recovery Act (RCRA);The Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA); The Federal Water Pollution Control Act of 1972 (the Clean Water Act); The Clean Air Act and EPA regulations that require large municipal solid waste landfills to install landfill gas monitoring systems and corresponding state laws and regulation. Drafts and otherwise contributes to internal Company reports. Prepares legal budgets and recommend reserves. Selects and manages outside counsel and internal legal staff. Provides training to management and other personnel. Analyzes case law and provide recommendations. Supports selection, preparation, disclosures, deposition, examination and defense of expert witnesses. Supports preparation of Company and other witnesses for deposition and trial and regulatory meetings and proceedings. Attends depositions, hearings, regulatory meetings and proceedings, and trials of significance. Participates in mediation and other forms of alternative dispute resolution. Assists with development and maintenance of Company policies and procedures, Legal Department administration, and other matters. Overnight travel outside of Arizona. Performs other job-related duties as assigned or apparent. The candidate should have 8+ years of experience performing the types of legal work listed above. Experience working in a large, multi-state corporate or legal environment is required. Must have in-house counsel experience. Knowledge of federal, state, and local statutes and regulations applicable to publicly-traded organizations is required. Experience advising clients in a unionized environment is essential. Must have JD degree; licensed to practice law and in good standing. 6+ years of experience as a practicing attorney is essential.
