Privacy Officer & Cybersecurity Counsel The candidate will be responsible for interpreting, setting corporate direction, and overseeing corporate compliance with the federal HIPAA Privacy rule (45 CFR Part 164 Subpart E Privacy of Individually Identifiable Information) and the federal HITECH Breach Notification rule (45 CFR Part 164 Subpart D Notification in the Case of Breach of Unsecured Protected Health Information). Will serve as the designated HIPAA Privacy Officer for CBC, CAAC, CAIC, KHPC and AIC. Additionally, this position plays a lead role in the Companys response to large-scale breaches or cyberattacks, involving the Companys PHI, including adhering to the BCBSA Data Security Incident System-wide Response Guide, and coordinating with Privacy Officials at all affected Blue Plans. Will also develop and implement related policies, practices, and training programs in coordination with enterprise colleagues, and help business stakeholders to understand and address data protection and privacy issues as they emerge in the development of new products and technologies. Will be expected to stay abreast of developments and trends in data protection and privacy laws and regulations, and to help lead company engagement with government and industry groups on data protection and privacy issues. Must have a JD degree and U.S. state bar membership in good standing are required. CIPP, CIPM, and/or CIPT certifications preferred. 10 years of experience attorney, in-house and/or at a law firm, including evidence of direct, hands-on experience providing legal counseling on data protection and privacy issues to healthcare systems, health insurers, insurers and/or large financial institutions. Substantial experience assessing legal risks relating to data protection and privacy, and identifying and advising on practical, compliant ways to mitigate such risks. Demonstrated experience identifying and resolving legal and regulatory issues quickly and effectively, with an ability to make real-time decisions. Demonstrated experience prioritizing conflicting demands from multiple business clients in an extremely fast-paced environment. Proven track record of project and process development, implementation and project management, with minimal supervision required. Proven ability to function as a member of a team in a complex, matrix environment, management experience. Experience in creating and delivering training programs and presentations to various audiences (prefer experience with both internal and external audiences). Experience in planning and setting corporate direction for area of responsibility.
