Director, Employment and Corporate Compliance Counsel The candidate will give day to day employment law advice: Provide practical and business-focused employment law advice and counsel, taking into account multiple stakeholder perspectives where necessary. Assess risks and offer client-focused practical solutions and options. Extensive day-to-day legal counsel and advice to HR and management: Provide practical and business-focused legal advice on a variety of labor and employment related matters, including workplace investigations, discrimination/harassment claims, FMLA and other protected leaves, ADA reasonable accommodations, employee relations issues, including discipline and terminations, wage and hour issues, background checks, drug testing, separation agreements, layoffs, employment agreements, restrictive covenants/confidentiality agreements, workplace violence, unemployment, affirmative action and OFCCP compliance, and employee data privacy. Deliver effective, business-focused responses to agency charges, attorney demand letters and litigation matters by and through the efficient and appropriate use and management of outside counsel. Partner with HR and other stakeholders to develop, implement, and monitor policies and practices to promote compliance and mitigate legal exposure. Draft, review, and analyze employment-related agreements, including consulting, severance, incentive compensation, and confidentiality agreements. Manage and evaluate outside counsel in the execution of strategies in employment claims and litigation, and provide creative approaches to dispute resolution and representation in connection with EEOC and State employment agency charges, while managing costs and in-sourcing matters when feasible. Partner/collaborate effectively with team members to ensure adequate reporting on litigation outcomes and learnings, internal/external trends, legal updates and projects updates, and to develop and/or deliver effective employment law training. Provide support to investigations required on ethics hotline related matters. Provide support for presentations to leadership and Board of Managers working Legal Department leadership, as well as privacy and information security governance. Support legal guidance on compensation policies, Long Term Incentive Plans, and related legal documentation and compliance, including tracking and record-keeping of legal documents. Support employee benefits, 401K and defined benefit plan matters. Maintain constructive relationships with clients, stakeholders and peers and work collaboratively to identify and assess options for resolving compliance issues. Collaborate and build positive, productive relationships with team members at all levels across the legal department. Provide legal advice and counsel to procurement personnel relative to reviewing, drafting, negotiating and complying with contractual terms and conditions. Develop and modify employment handbooks to ensure existing information and policies are accurate and current. Monitor changes in state, federal, and international, labor and employment laws to ensure compliance, and audit periodically for compliance with laws. Draft and review select Firm Policies and Procedures. Meet KPIs established for the Legal Department. As requested, review client engagement agreements and related documents (e.g., confidentiality agreements and nondisclosure agreements). Advise on select risk management matters. Interpret laws, rulings, and regulations for the Firm. Obtain appropriate clearance and approvals for projects, third-party engagements, and expenses, review outside legal counsel invoices for appropriate billings, amounts and scope, track and monitor outside legal expenses, and timely submits for payment with the appropriate descriptions. Assist with other projects, as needed. Juris Doctor Degree (JD) and 10+ years related experience and/or training in a similar environment; or equivalent combination of education and experience required. Broad and deep employment law knowledge; extensive, successful experience advising on the wide variety of employment law issues that arise in a corporate environment including investigations, policy development, HR projects, ADA/Leaves/Title VII, and improving compliance required. Compliance Office investigations experience required. Private law firm experience required. International employment law experience a plus. Must have intermediate skills in Microsoft Word, Excel, Outlook, and Internet navigation and research. JD Degree from an accredited law school and license to practice law in the State of Texas required. Membership to the American Bar Association and Association of Corporate Council preferred. Position requires regular interaction with employees at all levels of the Firm; interface with external vendors, attorneys, and clients also necessary.
