Legal Senior Counsel, Employment The candidate will be responsible for managing and implementing the companys employment law, benefits and compensation compliance and best practices in the Americas region. This position will be responsible for partnering closely with and providing routine counsel and legal support to the Human Resources organization across the Group's various affiliates. Will be the lead employment counsel in the region reporting to the General Counsel. The role will advise the business through the lens of supporting, protecting and challenging. Core responsibilities include the following: Provide legal advice on a broad range of employment-related issues including discrimination, harassment, wrongful discharge, performance management, employee discipline and separations, workplace investigations, business restructures and reductions in force, leaves of absence and accommodations, restrictive covenants, recruiting, hiring, benefits, wage and hour, compensation, and Immigration matters. Prepare and negotiate legal documents related to employment, including employment, independent contractor, severance, restrictive covenant and other HR-related agreements. Provide guidance to HR Organization on implementation of new policies and updates to existing policies. Partner with HR Organization to develop and maintain HR policies, procedures, and other documentation related to Human Resources and workforce management. Keep abreast of legal decisions, statutory changes and other developments impacting HR and the business, and proactively advise the company on same. Collaborate with HR Organization to ensure compliance with federal, state, and local and city laws including wage and hour. Conduct and/or advise on internal investigations and sensitive employee relations issues. Conduct employee-related merger or acquisition due diligence and advise on post-acquisition integration of such work forces. Handle employment-related disputes, including investigating and responding to EEOC and other federal, state, and city human rights commissions as well as to attorney demand letters on behalf of employees. Oversee and collaborate with outside counsel in the following areas, including development and management of budgets, guidance on strategy, and serve as liaison to internal clients. Immigration: Assist with overall compliance with Immigration laws and strategy related to global mobility within the organization. Employee Benefits:-Assist with overall compliance with ERISA and other employee benefit laws with respect to plan administration and operation. Litigation: Assist with defense of legal claims by employees in federal and state court. Foreign: Assist with ensuring legal compliance and responding to legal claims relating to HR matters in Canada, Mexico, Brazil, Panama and other countries within the Americas where company may establish operations. Prepare training materials and conduct training sessions regarding employment best practices. Review HR training materials for compliance. Develop strong internal relationships with regional and global HR teams and business leaders to become a trusted resource for the Human Resources organization. Build and manage strong relationships and gain organizational buy-in and adoption in a highly matrixed, global organization to ensure consistency and best practice sharing. Lead by example and positively influence stakeholders, clients and team members. Assist with subpoenas and other legal requests for information as needed. Perform other employment law and compliance and litigation related duties as required.

The candidate should have 10+ years experience as employment counsel, with sufficient experience and ability to handle responsibilities with minimum supervision. Both external law firm and In-house experience preferred. Exceptional organizational, interpersonal and communication skills. Ability to manage a variety of internal client demands appropriately and work in a fast-paced environment. Initiative and ability to work autonomously and set strategic goals, while remaining a strong and supportive team member. Exercise good judgment and recognize when to ask for help or escalate issues. Ability to handle sensitive / confidential information requiring a high level of discretion, respect and integrity. Strong time management, project management and prioritization skills, with the ability to multi-task and manage multiple projects / matters to closure. Strategic thinking with an ability to leverage business sense, creative problem-solving skills and sense of prioritization when resolving issues. Exceptional networking and relationship management skills; ability to influence change and instill confidence in stakeholders at all levels of the organization to help advance goals to promote compliance, risk mitigation and best practices in employment and workforce management. Prior experience operating in both global and/or highly matrixed organizations ideal. JD from an ABA accredited top law school, member of good standing in at least one State Bar, preferably in New York (or ability to register as In-House Counsel in New York). Familiarity with New York and California law a plus. Experience with retail or hospitality clients a plus.
