Senior Corporate Counsel, Employment The candidate oversees and manages the Companys litigation and employment practice and provides strategic legal advice to cross-functional business partners on a broad range of employment matters. Oversees the Companys compliance with federal, state and local employment and labor laws and assists the Company in mitigating against employment claims by proactively assessing and managing legal risk, and offering practical legal advice and solutions on a broad range of labor and employment matters that support best industry practices. Essential Responsibilities and Accountabilities: Provide guidance on all aspects of day-to-day employment-related matters, including, but not limited to hiring, discipline, training, terminations, investigations, accommodations, independent contractor issues, benefits and compensation, harassment, discrimination, retaliation, wage and hour issues, leave of absences, statutory claims and various issues involving the entire employment work cycle; Serve as the subject matter expert in all areas of federal and state labor and employment laws, including, but not limited to, Title VII, FMLA, NLRA, ADA, FLSA, ADEA, and OSHA. Manage the Company's defense of administrative litigation (DLSE, DFEH & EEOC), including formulating legal strategy, overseeing or performing the investigation and preparation of position statements, attending mediation and arbitrations, and negotiating settlement agreements; Conduct and/or supervise internal workplace investigations regarding sensitive matters; Manage and collaborate with outside counsel on employment-related matters including complex litigation; review pleadings; facilitate the gathering of information (documents, interviews, policies, employee information); Develop, prepare, and deliver internal training on a variety of employment law topics to assist in the mitigation of labor/employment lawsuits; Review and draft various types of employment agreements; Advise on legislative changes impacting the business and proactively identify risks and mitigating actions; Audit, draft, and implement employment policies and processes to ensure compliance with relevant laws and regulations that support best industry practices; assist in drafting job descriptions and preparing the Companys Employee Handbook; Conduct legal research and prepare legal opinions; remain up-to-date on changes in employment and labor laws and provide legal updates to Company. Secondary Duties: Assist in managing outside counsel in connection with general civil litigation and other matters; Provide substantive support for the rest of the Legal team as needed, including strategic transactions, contracts, and other ad hoc projects; Perform other duties as assigned. Requirements (Knowledge, Skills and Abilities): Extensive and substantive knowledge of California employment laws and its practical application; Excellent communication (written and verbal) skills; ability to communicate and interact effectively and appropriately with all levels within the Company; Proven contract drafting and negotiating skills; Education: J.D. from a school of law accredited by the American Bar Association. Licenses: California Bar License. Experience: 4 years of relevant professional legal experience practicing employment law, as an advisor and/or litigator, in a law firm or in-house legal department; Labor Law and Human Resources experience is a plus.
