Employment & Labor Attorney will provide legal counsel on labor and employment-related matters for the Company and its affiliates, which may include, human resources issues, wage and hour law, workers' compensation, unemployment, and other state agency claims, labor relations, employee benefits, employment agreements, and policy-related issues, FMLA matters, health, welfare and benefit plans, employment-related litigation, grievances, and arbitrations. Provides legal counsel and support to various departments of the Company, including members of senior management and the Company's affiliates and subsidiaries, to resolve various labor and employment problems of a legal or interpretative nature. Analyzes interpret and draft various legal and compliance documents, including legal opinions and associated analysis, contracts and other agreements, policies, and procedures, handbooks, training materials, etc. Enforcing restrictive covenants. Reviews, analyzes, approves and/or directs the processing of certain legal and compliance documents, as warranted and required in the operation of the department, including internal policies and procedures, materials relating to employer groups, subscribers, providers, and documents relative to other third parties, including but not limited to contracts and other agreements. Supports or oversees, as warranted, and with the assistance of additional and appropriate departmental staff, the Company's response to litigation of certain court or administrative matters Implementing short-term and long-term labor objectives and strategies. Complying with the National Labor Relations Act. Drafting employment agreements and policies. Assisting in arbitration and mediation. Develops multi-state expertise in all aspects of employment law compliance and provide legal advice and counsel on application of applicable laws, including, the Fair Labor Standards Act, Employee Retirement Income Security Act (ERISA), Family and Medical Leave Act (FMLA) and Military Family Leave Act (MFLA), Americans with Disabilities Act Amendment Act (ADAAA), Workers' Compensation laws, Civil Rights Act, and Occupational Safety and Health (OSH) Act, experience with the National Labor Relations Act (NLRA). Advising during union organizing campaigns. Collaborates in the development and implementation of human resources policies and procedures with guidance from human resources management. Provides advice and counsel regarding organizational design and other new or existing projects or initiatives involving impacts to people in partnership with the Human Resources teams and other relevant cross-functional teams. Provides advice and counsel regarding all facets of the Company's hiring and separation processes. Supports the development and implementation of Company philosophies, guidelines and policies relating to all areas of employee relations, labor relations, and employment law. Oversees and assists with negotiating Labor Peace Agreements and Collective Bargaining Agreements, as appropriate. Handling collective bargaining and labor arbitrations. Assisting with the development and delivery of employee training content. Manages claims, charges, and grievances filed against the Company and support in-house and outside counsel with the management and defense of employment litigation. Assists Human Resources and the Compliance Department with workplace investigations into alleged wrongdoing. Foster positive employee relations through crafting and implementing interactive management training. Counsel human resource professionals with regard to day-to-day workplace issues. Assist in the development of strategies required for opening new facilities, mergers, relocations, consolidations of existing facilities, acquisitions, subcontracting, reductions-in-force, and drafting and reviewing buy-sell agreements for asset or stock transactions.

Qualifications: Must have a JD Degree from an accredited law school. 5+ years of experience with Unions. 10+ years of experience with Corporate labor role. Licensed to practice law in the state of Massachusetts (Member of the Massachusetts Bar) Multiple state Bar admissions are a plus. First-chair experience handling employment trials is a plus. Must have a wide range of labor and employment law experience, business acumen, dispute resolution, and leadership skills. Substantial employment litigation and counseling experience. Significant experience representing employers, large and small, in employment disputes. Trial experience is a plus. Must also have extensive experience with complex labor and employment law matters and must be willing to work collaboratively/cross-market with members in other practice area groups. Mature, experienced team approach to the practice of law. Influential people skills suitable for a client-focused business. Strong academic and professional credentials. Ability to prioritize and to work independently. Demonstrated ability to work well in a team environment and bring added value. Sound legal judgment, initiative, and versatility.
