Intellectual Property Counsel The candidate will be responsible for: Partner with the Company's research and development organizations, business units, and rest of the Legal department to provide counsel on a wide variety of IP related matters. Advise and counsel clients on various IP matters involving copyrights, patents, trademarks, and trade secrets. Directly perform, or manage outside IP counsel on, a wide variety of work product including drafting, filing, and prosecuting patent applications before the USPTO and foreign counterparts and drafting freedom-to-operate and/or invalidity opinions. Manage invention submission and review processes, active involvement with internal research and development / product development teams and evaluation of patentability of proposed innovations. Contribute to the Company's global IP strategy with a focus on alignment of the IP portfolio with the Company's business needs, priorities and resources. Provide strategic counsel and updates to the Company regarding the competitive IP landscape for the Company's product portfolio and IP issuing for the Company's competitors and customers. Maintain a solid understanding of the Company's businesses, technology and product goals, and challenges. Ability to counsel and meet the needs of multiple internal clients. Develop and deliver training to address knowledge needs in relevant areas of IP law for the applicable employee audience. Participate in M&A activities in relation to IP due diligence and transactional issues. Provide legal advice for marketing teams including review of promotional content and brand strategy involving trade names and trademarks. Work collaboratively with other in-house lawyers, scientists, and business partners to execute the Company's commercial strategy. Responsible for NDA review, management, and compliance. Demonstrate high integrity and ethics in all dealings. Professional maturity and confidence in expressing a point of view with management. Non-political. Independent of perceived popularity of the advice given. Keep informed of new developments in corporate legal matters and advises internal clients accordingly. Willing to work on the smallest and simplest, as well as the most complex, legal matters faced by the company. Must have Juris Doctor (JD) degree and licensed to practice law in the State of Colorado. Should have 10 years experience in a corporate legal environment and/or private practice on IP matters with preferred experience being in strategic intellectual property counseling, licensing, litigation management, and other complex business transactions, and in prioritizing multiple tasks under pressure. Preferred experience includes a materials science and/or engineering background. Working knowledge of transactional and commercial law, preferred. Admission before the United States Patent and Trademark Office required.
