Managing Counsel, Business Litigation The candidate primary responsibility of this role is to manage complex business litigation matters. Reporting to the Vice President Product Enterprise Risk, Deputy General Counsel, the person in this role will support the TL1 and Business Litigation group objective to strategically manage and direct business litigation, including class actions, commercial litigation and arbitrations, intellectual property (IP) litigation, government investigations and regulatory matters. Oversee a portfolio of complex business litigation, including consumer class actions (product and non-product related), commercial disputes, IP litigation, government investigations, and regulatory matters involving a variety of Toyota entities. This includes: Managing strategy, fact investigation, and legal analysis. Coordinating discovery and eDiscovery, witness preparation, and trial and hearing preparation. Partnering with outside counsel to achieve effective and efficient case handling. Communicating regularly with management and other stakeholders. Supervising paralegal and administrative support. Evaluate and advise on pre-litigation claims, subpoenas, demand letters. Provide advice and counsel to a variety of business units regarding commercial and product issues involving advertising, product regulations and compliance, dealer and distributor related product matters, vendor relationships, and team member training. Handle special projects and other matters as requested to support the Litigation Group and TL1.

The candidate should have Juris Doctor degree from an ABA-accredited law school. Admission to the Texas State Bar, or admission to another U.S. state bar and able to obtain license to practice in Texas is required. Must have extensive experience at a major law firm and/or in a corporate law department litigating complex business matters. Should have extensive litigation experience in all aspects of case management, including development of litigation strategy, discovery, dispositive motion practice, settlement negotiation, mediation, arbitration, trial, and selection and management of outside counsel and experts. Should preferable have Significant experience in automotive matters, including litigation in state and federal courts and administrative agencies. Solid experience in product liability and/or automotive regulatory matters is preferred. Should preferable have Experience with IP (patent, copyright and/or trademark) litigation. Experience with distribution and antitrust laws is desired. Strong customer focus and interpersonal skills are required. Must have strong drafting and communications skills. Should have strong analytical, organizational and process-development skills. Proficiency with Microsoft Word, Excel, and PowerPoint is needed.
