Corporate Counsel - Employment Law The candidate will manage labor and employment issues throughout the US. Partner directly with the Human Resources team and business functions to provide employment-related legal advice and services for the Company. Manage, train and develop direct reports. Provide practical, timely and thorough legal guidance and counseling on a range of employment issues including: recruiting; hiring; employee relations; discipline and terminations; internal investigations; leaves of absence; wage and hour compliance; disability accommodation; labor relations; union organizing campaigns; EEO compliance; and performance management. Managing litigation, government agency investigations, proactive training, and administrative charges as well as the assessment, selection, and supervision of outside counsel. Oversee or conduct investigations related to alleged violations of company policies, laws, and regulations. Investigate and defend state and federal charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents. Drafting of employment, settlement and separation agreements. Assist in development and presentation of education and training materials. Assist in employment-related aspects of company special projects such as mergers/acquisitions, as well as reductions in force and location closings (e.g., severance, WARN Act). Support preparation of materials for quarterly reporting up of employment law and compliance matters to senior executive leadership and Compliance Committee. Assist and provide guidance in crisis management situations. Advise and update the business about changes in Federal, state and local laws and regulations (Title VII, FMLA, FLSA, ADEA, ADA, etc.), including updating policies and handbooks, as necessary. Management of employment litigation budget and outside counsel spend. Perform records research, and legal and factual research and prepare memorandums of findings, as necessary. Organize and track case files in legal database reporting system (including preparation of written reports such as claims and litigation holds and reports).

The candidate should have 7+ years of legal experience, with a mix of corporate law firm and in-house experience is preferred. Florida Bar member in good standing, required. Some private practice litigation experience is preferred. Strong organizational, analytical, practical problem-solving, and critical-thinking skills, as well as the ability to identify risk. Common sense and ability to demonstrate sound judgment even in ambiguous situations. High level of interpersonal skills, ability to work with and influence peers and senior management, and ability to work in a proactive and service-oriented manner. Self-motivated with critical attention to detail, deadlines and reporting. Ability to work independently while being able to contribute successfully to cross-functional teams. Prioritize and manage multiple projects at once, efficiently manage a large caseload. Strong written and oral communication skills. Ability to handle sensitive and confidential information. Ability to travel and work extended hours when necessary and willingness to be available during restaurant operating hours to give immediate guidance as needed. Proficient at budgeting and project management (from conception to completion) skills.
