Associate General Counsel - Litigation The candidate will be valued member of the Litigation and Investigations team. Provides advice to internal departments on various issues, including in the areas of potential litigation claims, investigations, regulatory enforcement and sensitive customer complaints, and is responsible for devising strategy and actively handling and managing complex litigation matters. Develops substantive position and strategy, and actively handles pending and threatened litigation, arbitration, investigations and regulatory enforcement matters, and reports on certain matters. Handles all phases of litigation- both affirmatively and defensively- including complaint, discovery, expert testimony and trial. Responds to demand letters. Actively supervises outside counsel on certain matters. Evaluates exposure at outset and throughout life of case, and negotiates settlements. Monitors litigation related budgets and proposes cost efficiencies, and actively engages with insurance carriers and tracks compliance with insurance policies. Assists in preparing department budget. Assists in preparing company witnesses for depositions and other testimony. Conducts legal research and drafts memos, position statements, briefs, motions and other litigation and arbitration filings. Coordinates, negotiates and executes responses to discovery requests and subpoenas. Drafts legal holds and coordinates e-discovery collection. Develops strategy, participates in internal investigations, interviews witnesses, and drafts investigation reports. Advises on sensitive customer relations issues. Assists with company audits and reviews. Provides day-to-day legal advice to internal departments, including on litigation risk. Actively engages with stakeholders to assess risk, and proactively proposes solutions to mitigate risk. Works collaboratively across various Legal teams, and builds and fosters relationships across all levels of the organization. Works independently and efficiently under time pressures and deadlines. Actively engages and takes ownership of matters. Other duties as assigned. Reports to VP/Deputy General Counsel.

A Juris Doctorate from ABA accredited law school required. Admission to the bar of at least one state required. 11+ years of experience required, 13+ years preferred. Law firm experience preferred. Should have Significant experience handling complex litigation in all forums, including first or second chair trial experience and working with expert witnesses in complicated matters. Must have successful track record of early case resolution. Successful track record of creating or improving existing litigation processes is required. should have ability to formulate and execute effective strategies to reduce risk and apply consistency throughout the Company's litigation function. Must have experience with internal investigations, shareholder demands and actions and regulatory enforcement actions. Experience with international investigations/cases, affirmative recovery actions, employment actions, or broker-dealer litigation/arbitrations a plus. Must have excellent verbal and written communication, negotiation, presentation, analytical and problem solving skills. should have ability to effectively interact with all internal and external business partners, and exercise independent judgment. Must have ability to take a proactive long-term view of business goals and objectives in order to achieve strategic business results. Working knowledge of Microsoft Office-Word, PowerPoint, Excel and Outlook is required.
