Counsel - Privacy The candidate will be responsible for supporting privacy program leadership to advance and mature firm's Privacy Program, including in support of its subsidiaries. Assist in developing and maintaining firm's privacy program, and related policies, procedures, documentation, and communication materials. Maintain knowledge of current and proposed laws, regulations, sub-regulatory guidance, contracts, at the Federal and State level, applicable to firm's and its subsidiaries business. Collaborate with Privacy leadership and key internal stakeholders to ensure the organization possesses the appropriate privacy and confidentiality consent documentation, authorization forms, and notice of privacy practices. Independently manage projects related to ongoing compliance with privacy and data protection laws, and related requirements. Analyze root causes, trends, and systematic issues and prepare reports on the same. Serve as a seasoned resource to other members of the privacy team. Handle complex assignments in an unclear situations, especially in the context of privacy incident investigations and handling of member complaints. Reviews, negotiates, and drafts a wide range of agreements and contracts on behalf of the company. Works closely with other departments to foresee and protect company against legal risks. Assists Privacy Officer in providing advice to the company on aspects of privacy and data protection compliance. In conjunction with other corporate stakeholders, monitors advancements in information privacy and cybersecurity technology law and privacy law to ensure organizational compliance. Works autonomously.

The candidate should have a Juris Doctorate degree from an ABA accredited law school. Must be admitted to a recognized bar. Requires 5 to 8 years of experience in a law firm and/ or in-house legal department. Requires 3-5 years of experience in a privacy role. Requires highly effective verbal, written, and interpersonal communication skills. Strong oral, and written communications skills. Requires strong analytic and problem solving capabilities and the ability to identify solutions and recommendations that effectively address business and control needs along with how to train and guide others in this area. Requires a proven record of meeting commitments and achieving goals through the encouragement, guidance and influencing of others. Requires working knowledge of Microsoft Office applications. Requires some local travel. Subject matter expert in relevant statutes, regulations, and sub-regulatory guidance relating to health plans, and specifically privacy preferred. Experience interacting with regulators regarding statutory/regulatory requirements, compliance issues/risks, and regulatory audits preferred. Experience in one or more operational areas (e.g., appeals, claim processing, medical management, provider network management) at a health plan. Nationally recognized privacy certification, such as those offered by the Health Care Compliance Association and the International Association of Privacy Professionals preferred. Experience with conducting privacy risk assessments preferred. Experience with state privacy and cybersecurity laws preferred.
