Senior Counsel, Global Privacy The candidate will develop strategies for and lead data privacy compliance projects in order to prepare the company for a new data and evolving privacy regulations, such as CPRA and EU cross border data requirements, including development of multi-phase project plans, policies, procedures and guidance, and management of project milestones and cross functional collaboration across the matrix. Provide strategic and pragmatic legal advice on complex data-driven commercial initiatives including programs that support the patient journey with wearables, mobile applications, artificial intelligence, data analytics, software as a medical device, text messaging and innovative marketing programs and technologies. Draft privacy statements, enhanced notices and other disclosures as needed. Interpret and apply privacy and data protection law requirements in the areas of clinical development and scientific research including: secondary use, real world data acquisition, informed consent and clinical trial agreement template modifications, collaboration agreements, issues on anonymization, deidentification and collection and management of genetic data and samples. Partner with business leaders to strategically assess potential privacy risks with innovative new initiatives and develop appropriate controls, training and guidance to ensure compliant execution. Facilitate US patient engagement by partnering with business on development of HIPAA compliant solutions including counseling on complex data and legal issues and risk related to patient support and other commercial patient engagement programs. Co-lead with VP of Information Security response to potential and actual data breach incidents and support the Company's cybersecurity incident response program identifying applicable legal obligations, advising on potential liability and updating SOPs and work instructions based on lessons learned and evolving law. Provide day to day legal advice in support of ongoing GDPR requirements including data subject rights requests, data protection impact assessments, and Article 30 personal data inventory. Coordinate with local lawyers globally to facilitate markets compliance with global and regional privacy requirements including in connection with enterprise wide projects and enable implementation of privacy policies and procedures; manage outside counsel and third-party consulting firms on discreet projects. Should have 10 years of privacy experience at a law firm or in-house legal department. Must have demonstrated understanding of privacy and data protection laws and regulations, including, GDPR, TCPA, CAN-SPAM, CCPA, HIPAA, US state data breach laws. Should have excellent oral and written communication skills, strong interpersonal skills, ability to work well both independently and cross functionally. Must have JD from accredited law school, demonstrated academic achievement, and current bar membership in good standing. Knowledge of the healthcare/pharmaceutical industry preferred. Certified Information Privacy Professional (CIPP) desired. Deadline: January 1, 2021.
