Director, Employment Counsel Responsibilities: Advising on employment law and HR matters, including recruiting, hiring, benefits, compensation, performance management, discipline, terminations, internal investigations, leaves of absence, employee relations, discrimination, harassment, retaliation, wage and hour compliance, contingent worker matters, regulatory compliance and employment risk management. Developing and revising policies, procedures, templates and forms, including employee handbooks, to ensure employment law compliance. Drafting, reviewing, analyzing and negotiating employment-related agreements, plans and policies, including consulting, severance, offer letters, executive employment, incentive and equity compensation, invention assignment, non-interference and non-solicitation, confidentiality and separation agreements. Reviewing and advising on potential risks associated with performance management and termination decisions, including mutual separations, reductions-in-force and terminations for performance or cause. Partnering with Human Resources and other teams to investigate and respond to employee concerns, including allegations of discrimination, harassment and retaliation. Overseeing litigation, arbitration and dispute matters, including handling administrative proceedings where appropriate, managing outside counsel, reviewing litigation-related court filings, collaborating on litigation strategies, coordinating with insurance providers and brokers, determining appropriate settlement value/authority, attending mediations and court conferences, and managing costs. Managing interactions with employment and labor regulatory bodies (i.e., EEOC, Department of Labor and local agencies), including response to and defense of inquiries, audits and investigations. Ensuring's U.S. benefits plans and programs comply with applicable laws. Partnering with legal and business colleagues on privacy and data protection matters. Providing advice and developing strategy on company-wide initiatives affecting employees. Providing educational information and conducting trainings and presentations on employment matters, including anti-harassment and managing within the law training. Supporting diversity, equity, and inclusion efforts. Supporting COVID-19 response, safety and remote work efforts. Supporting pay equity, pay ratio, and auditing efforts. Providing employment law support for business development and M&A transactions. Coordinating with Human Resources and outside counsel to ensure compliance with immigration laws. Coordinating with Finance, outside counsel and relevant stakeholders to ensure appropriate and ongoing insurance coverage applicable to employee liability and related matters. Monitoring legislation, regulations, case law and government enforcement activities related to employment issues and providing proactive, strategic advice to relevant stakeholders. Proficiency in the Microsoft Office Suite, Outlook, Word, Excel and SharePoint.

Qualifications: Bachelor's degree and JD Degree required. JD Degree from an accredited U.S. law school; admitted to at least one state Bar (preferably CA). 7-15+ years of relevant experience in HR & employment law, with California law experience required and a strong preference for prior in-house experience. Experience in the pharmaceutical or biotechnology industry and general familiarity with and strong understanding of pharmaceutical operations, core healthcare laws and regulations preferred. Experience and skill at writing policies and guidance documents supporting various business activities and conducting investigations. Deep understanding of U.S. (including California) employment laws, regulations and best practices. Working knowledge and familiarity with data privacy and protection laws, such as the California Consumer Privacy Act (CCPA) and European General Data Protection Regulations (GDPR) a significant plus. Excellent drafting, negotiation and communication skills, with the ability and confidence to represent *** in employment matters. Proactive and hands-on experience supporting HR and other clients with the design and implementation of employment law and HR-related projects, such as contingent worker programs, pay audits, hiring of employees in new jurisdictions, etc. Ability to build strong cross-functional relationships and influence others without direct line reporting authority. A demonstrated ability to collaborate, as well as to work independently, balancing competing priorities in a fast-paced environment with a high level of professionalism. Ability to understand complicated laws and regulations and translate them into practical, business-oriented legal counsel. Ability to handle confidential and proprietary information using excellent and sound judgment. Ability to be flexible and willing to accept new responsibilities as needed.
