Senior Associate Legal Counsel - Employment & Labor Relations

Senior Associate Legal Counsel - Employment & Labor Relations Duties: Advise senior management, parent company, and affiliates on a full range of employment and labor matters, including recruitment, employee performance, employee benefits, labor relations, and personnel disputes. Represent the corporation in all labor negotiations and union-related matters, leading a legal team to include outside counsel. Negotiate and draft employment contracts, separation agreements and settlement documents. Provide advice on federal and state employment laws and regulations, including Title VII of the Civil Rights Act, Fair Labor Standards Act, Family Medical Leave Act, Americans with Disabilities Act, Fair Credit Reporting Act, EEO/AAP, etc. Examine pending or current legislation and advise appropriate persons of pertinent court and administrative decisions. Participate in litigation risk avoidance and management, including conducting mediations, handling agency proceedings, managing and selecting outside counsel in arbitration and court proceedings. Review, recommend, develop, and assist in implementation or revision of Human Resources policies and procedures. Develop, distribute, and provide training to appropriate group(s) regarding employment law developments that impact the organization. Team with Human Resources staff to assist with employment-related matters, including investigations. Draft and review documents and provide advice on compliance-related issues, including OFFCP regulations and affirmative action reporting. Represent the Company's interests before the courts, regulatory agencies, administrative state and local agencies, commissions, and other outside groups. Serve as the subject matter expert on employment matters for the Company. Counsel and render legal opinions, memorandums and recommendations helpful to management. Proactively manage outside counsel on labor, employee, benefit, and compensation matters, including possibly ERISA matters. May provide technical guidance to less experienced attorneys. Qualifications: JD Degree. Bar membership in Maryland, Virginia or the District of Columbia required. 10+ Years of progressive legal experience after receiving law degree preferred, including 7+ years of experience specializing in employment law, labor relations and litigation. Experience in cross-border (US-CAN) employment and labor issues favored. Requires versatility in handling employee and labor relations and related matters, including the ability to anticipate issues of importance to the regulated utility and its international parent. Requires the ability to prioritize time spent between the regulated utility (80%) and its international parent and affiliates (20%). Experience successfully negotiating legal agreements and resolving disputes with a high degree of discretion and trust. Demonstrated extensive knowledge of several legal disciplines and the practices and procedures required to solve highly complex work initiatives in a legal environment. Proven ability to successfully resolve disputes with business partners. Demonstrated experience in a leadership role in directing established teams or projects to successful completion of targeted goals. Proven ability to successfully negotiate business agreements and to resolve disputes with business partners. Demonstrated ability to conceptualize and analyze multiple scenarios in solving broadly defined or complex business problems. Demonstrated ability to effectively communicate complex messages to diverse audiences to all levels of an organization. Proven ability to use computer software and applications, including Microsoft Office, to share, retrieve, research and present business and legal information.
