Labor and Employment Attorney The candidate will provide in-house legal counsel on labor and employment-related matters, which may include human resources issues, wages and hour law, workers compensation, unemployment, and other state agency claims, labor relations, employee benefits, FMLA matters, and employment-related litigation. Ensure compliance with all applicable laws, regulations, and policies. Identify and assess legal risks and opportunities within the labor and employment area and advising accordingly. Counseling clients and stakeholders on labor, employment, and civil service matters. Handle contested administrative evidentiary proceedings. Represent the company in federal and state administrative charges (EEOC, DOL, and comparable agencies). Draft court papers, motions, and briefs and manage e-discovery issues. Develop and deliver training and education on a variety of employment and labor law topics. Special projects include legal team POC for employee equity plan and equity/corporate planning and strategic matters, supporting the expansion of legal HR-related compliance, programs, and policies, and contributing to HR-related incentive programs and support of the organization. Handle DOL Audits and EEOC charges, including defending investigation, preparing position statements, defending clients in fact-finding conferences and on-site visits, representing clients in mediations and conciliations, and negotiating settlements. Also, handle all aspects of the discovery process and drafting motions.

The candidate should have a Juris Doctor degree from an accredited law school. Must have 8 years of substantive labor and employment experience with a corporate legal department. Experience in ligation including drafting responsive pleadings is required. Should have familiarity with EEOC, Department of Labor, and other federal, state, and local government administrative agencies. Must be familiar with Texas Labor Codes. Understanding of constitutional law and knowledge of equal pay act, age discrimination in employment, Americans with disabilities act, fair labor standards act, texas commission of human rights act, family and medical leave act is needed. Demonstrative cooperative approach and enjoy working with experienced lawyers and human resource professionals sharing ideas and best practices is essential. Should be passionate about customer service and excels at problem-solving. Strong organizational, time management, and communication skills are desired. The ability to understand and apply advanced legal and regulatory concepts and to autonomously structure processes, future planning, and management guidance is a prerequisite.
