Employment Counsel The candidate will collaborate cross-functionally to build and implement scalable, world-class, and business-friendly employment policies and programs. Provide counsel to business partners, including human resources, safety and management, on a broad range of employment issues, including recruiting and hiring performance management, leaves of absence, accommodations, compensation and benefits, workers compensation, unemployment and other state agency claims, FMLA and ADA matters, executive compensation, employment-related administrative agency complaints, unionization and contingent workforce matters. Proactively manage employee relations and provide legal counsel, risk assessments and resolutions. Recommend interventions and solutions to facilitate an open, inclusive, values-based environment that enables effective employee relations. Lead and manage internal investigations, audits, employment law claims, pre-dispute conflicts, and other employment compliance-related issues, ensuring best practices when it comes to attorney-client privilege. Roll out, monitor and respond to anonymous whistleblower reporting mechanisms. Interpret labor and employment case law and regulations; recommend and roll out changes to ensure continued compliance with applicable laws, policies, and regulations. Maintain awareness of current and applicable developments in the legal and regulatory landscape, continually reviewing and analyzing trends that could impact business. Collaborate deeply with the EH&S team on OSHA compliance and policies. Advice on classifications, including exempt/non-exempt and contractor/employee, and provide training to recruiting and people business partners on making those classifications. Continuously enhance processes to ensure trade secret protection, including the following separation from the company. Advice on separations and severance agreements. Create and deliver engaging and educational training related to employment matters, such as HR best practices and attorney-client privilege. Supervise, manage, and evaluate outside counsel on labor and employment-related matters.

The candidate should have a Juris Doctorate (J.D.) from an accredited law school. Current member in good standing with the California bar. Should have 8 years of relevant legal experience, including in-house. Working knowledge of labor and employment laws, rules, regulations and best practices. Experience handling employment-related disputes, including experience with mediation, arbitration and/or litigation. Experience with or in fast-paced high-growth companies. Excellent communication skills, both verbal and written. Deep knowledge of US federal and CA employment laws. Knowledge and/or familiarity with other jurisdictions (particularly MO, FL, and DC) is a plus. Organized and efficient with strong follow-through and accountability. Proven success in taking a business through scale and building out legal programs to support that growth.
