Counsel, Data Privacy and Consumer Compliance The candidate will advise all internal clients on the development, collection, use, transfer and governance of data. This will include data analytics, privacy and security (both from a U.S. and an international perspective) (GDPR, CCPA, CPRA, COPPA, etc.). Draft and/or enhance privacy program-related policies and standards; conduct Data Protection Impact Assessments and other risk assessment activity as needed. Oversee uses of data for growth marketing and advanced advertising to ensure compliance with privacy and consumer protection laws. Advise internal clients on consumer-facing laws, regulations and best practices. Manage, draft and update privacy policies, terms of use, terms of sale and legal notices across all properties and platforms. Partner with key business stakeholders on the company's marketing and data governance compliance efforts. Review, draft and negotiate data protection agreements and work closely with the appropriate teams to advise on third party risk reviews; Handle the full commercial contracting cycle for heavily personal data-focused deals. Provide legal advice in connection with product and platform developments and releases including in relation to developments by major technology platforms. Track and counsel clients on legal developments in areas of data privacy and consumer marketing and subscription compliance and guiding business teams through application of and implications of such developments. Conduct and/or advise on internal and external audits related to areas of coverage. Conduct comprehensive business risk assessments to identify potential areas of vulnerability and risk; develop/implement risk mitigation and corrective action plans where needed. Advise on company-wide training strategy and execution for areas of coverage. The candidate should have a Juris Doctor and 5 years of combined experience in the areas of data privacy and protection, negotiating data privacy-related agreements and understanding of the interplay between technology and data privacy and advising on consumer-related issues, including payflow, subscription offerings, marketing copy, ARL, anti-spam, TCPA, TSR, UDAP, customer care, cancellation, credit card notice requirements, etc. Previous in-house experience preferred. Ability to contribute to discussions of general business issues and work well with a wide range of clients. Ability to analyze complex legal and regulatory material and communicate any implications in a clear manner. Ability to understand and counsel clients in a manner consistent with the Company's goals and culture. Excellent judgment and professional integrity.
