Corporate Counsel, Technology (Remote) The candidate will be subject matter expert on HIPAA, CCPA, CPRA, biometrics legislation, 21st Century Cures Act -The Information Blocking Rule, working knowledge of PIPEDA, LGPD, the GDPR and other privacy laws; data security; use of de-identified data and other data issues applicable to healthcare. Provide expert legal advice and counsel to the business on compliance with anti-kickback and other relevant laws. Collaborate with information security and privacy team on potential data breach responses. Work closely with and support leaders in the Sleep & Respiratory Care, Intellectual Property, and SaaS legal teams, particularly in North America, to ensure alignment of commercial, compliance, and regulatory goals. Serve as an escalation point for legal questions from ResMed's chief privacy officer and other members of the privacy team. Coordinate activities with global counterparts to deliver repeatable and predictable legal advice to global commercial clients seeking input on US and other North American laws. Supervise outside counsel on issues and projects outsourced by the legal department, principally in privacy and healthcare/digital compliance. Focus on development and implementation of strategic and operational objectives that help achieve organizational mission and departmental goals. Contribute to and manage projects involving the legal and compliant use of personal data. Advise legal department contracts team on agreements involving complex or highly technical subject matter, particularly in the area of digital health. Interact with management and/or major customers and strategic collaborators (e.g. EHR, big tech and health service companies). Interactions frequently involve special skills, such as explaining, advising and influencing senior level leaders, particularly with respect to privacy and compliance issues. Review data sharing agreements, CCPA, CPRA, cloud-suppliers/vendors privacy notices and terms, and provisions escalated by the contracts or product development teams. Knowledge of general corporate matters, corporate governance, licensing, cloud-based and platform as-a- service agreements, and contract management, among other topics. should have a Bachelor's degree, law degree from accredited law school, eligible for California in-house registration. Must have 7 years of experience in privacy, compliance, and healthcare law. One or more International Association of Privacy Professionals, CIPP/US credential, or a similar certification preferred. Demonstrated ability to provide strategic thought leadership and commercial and privacy advice on data analytics, digital health, and projects involving data processing, licensing, biometrics, artificial intelligence and machine learning. Strong analytical skills to track latest laws and regulations and proactively determine opportunity or impact on ResMed's digital health strategy and business models. Experience analyzing and responding to incidents and HIPAA breaches strongly preferred. Looks beyond existing methodologies and own discipline to define and resolve complex problems by thinking practically, has in-depth knowledge of organizational objectives. Demonstrated versatility, curious to tackle and learn matters outside of expertise, and sound judgment. Sound cross-functional collaboration, ability to strategically prioritize, keep up with a fast-paced entrepreneurial type of environment. Litigation experience preferred. California resident preferred, will consider remote location for the right candidate. Experience working on global projects or across cultures a plus.
