Labor and Employment Associate Counsel The candidate will provide day-to-day proactive employment law advice, assistance and counsel to HR and management on a variety of subjects, including hiring practices and procedures, employee performance management and separations, FMLA and other protected leaves, ADA reasonable accommodation, COVID-19 regulatory compliance and wage/hour compliance. Help drive compliance with labor and employment laws and regulations, including the development, implementation, interpretation, and maintenance of employment-related HR and operational policies and procedures, as well as developing and delivering training materials. With assistance from outside counsel, oversee labor relations items such as the negotiation of collective bargaining agreements, handling of union grievances, labor arbitrations, and Unfair Labor Practices charges, implementation of union avoidance best practices and responses to labor organizing campaigns. Oversee outside counsel in the management of employment-related litigation. Work with outside counsel, and manage Canadian labor and employment matters. Conduct or oversee internal investigations of reports to the company's anonymous reporting line. Serve as a key member of the employment law team, leading special projects to identify and proactively manage employment-related legal risks such as in connection with mergers/acquisitions, reductions in force and location closings (e.g., severance, WARN Act). Assist in the development and presentation of education and training materials to HR and business stakeholders. Draft employment, settlement and separation agreements. Investigate and defend state and federal agency-level charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents. Support preparation of materials for quarterly reporting up of employment law and compliance matters to senior executive leadership.

The candidate should have a Juris Doctorate degree (J.D.) from accredited law. Should have 5 years of labor and employment counsel experience. Retail experience preferred. Bilingual (Spanish) preferred. Law firm experience preferred. Experience investigating and defending state charges of discrimination, wage/hour audits and other regulatory complaints, including preparation of position statements and other responsive documents. An ability to provide sound legal advice and effectively integrate business and legal issues in such advice. Strong attention to detail, organization, and problem-solving skills. High level of interpersonal skills and ability to work in a proactive and service-oriented manner. Exceptional written and oral communication skills. Ability to handle sensitive and confidential information. Ability to influence others. Demonstrated ability to work on a variety of projects at the same time, to prioritize and to meet deadlines. Must have a collaborative style and ability to work in a team environment. Self-starter with strong work ethic. Some overnight travel required.
