Associate General Counsel - Privacy The candidate will own responsibility across the enterprise for all legal aspects of data privacy, information security and related compliance efforts. This role will work closely with senior leaders throughout the company, including marketing, product, engineering, technology, information security, commercial contracts, partnerships and many more. Lead data privacy initiatives and develop short-term and long-term strategic plan(s) for privacy program(s) across lines of business in multiple jurisdictions. Identify priorities along a multi-year journey and develop a framework for communication and management. Provide strategic legal advice and guidance on a wide variety of privacy program legal needs, including privacy impact assessment (PIA) activities, privacy by design leadership, data governance, contracting and incident response. Maintain subject matter expertise in privacy and data protection requirements, including US state and federal laws, the GDPR, and other global privacy laws. Collaborate effectively with executive leadership across Shutterfly businesses and functional areas, including Product, Engineering, Information Security and Marketing. Prepare and deliver presentations to the enterprise Privacy Steering Committee. Analyze, document, and communicate the impact of privacy laws and regulations on business and operations to executive management and other internal stakeholders. Monitor changes to laws, regulatory enforcement trends and the industry landscape to stay ahead of evolutions, trends, and best practices to inform business privacy strategy and privacy program roadmap. Assist with a wide variety of other matters that are part of the work of an in-house attorney and perform other duties as assigned.

The candidate should have 8+ years of relevant legal experience, with prior in-house experience and some experience at a top-tier firm preferred. Deep knowledge of domestic and international consumer data protection legislation (GDPR, CCPA, VCDPA, CPA, COPPA, TCPA, PIPEDA); knowledge of education sector privacy law (FERPA, SOPIPA etc.) is preferred. Experience with global privacy legal requirements and emerging standards, including those relating to digital advertising, AI/ML, data analytics and other technologies. Demonstrated experience in establishing, maintaining and maturing privacy governance and compliance programs. Strong working knowledge of data security laws, rules, regulations, and self-regulatory guidelines, as well as major technology platforms privacy requirements and developments. Strong executive presence and ability to navigate complex legal matters with senior leaders. Management experience is strongly preferred. Strong business acumen. Hands-on and curious and passionate about changes in the law. D. from an accredited law school with an excellent academic record. CIPP certification(s) preferred. Member in good standing of State Bar. Strong oral and written communication and interpersonal/relationship-building skills, including the ability to communicate legal considerations to non-lawyers. Ability to analyze complex legal and regulatory material and communicate any implications in a clear manner. Ability to quickly learn and understand complex technical and data environments. Ability to understand and counsel clients in a manner consistent with the Company's goals and culture. Excellent judgment and professional integrity. Ability to be proactive, exercise independent judgment and demonstrated ability to work effectively on cross-functional teams with all levels of management and other company personnel.
