Director of Claims Legal The candidate will be responsible for all legal and regulatory-related claims issues. Directly manages Claims Attorneys, Litigation Claims Managers and Large Loss Adjusters. With Claims Attorneys and Litigation Claims Managers, directly monitors certain claims to ensure that claims are executed consistent with good faith file handling requirements. With Claims Attorneys and Litigation Claims Managers, may provide guidance on the underlying part of matters that are listed on the Watch List. Provides guidance, mentoring and counseling on policy and coverage interpretation. Provides legal analysis and opinions on coverage issues. Determines if the involvement of panel counsel is necessary to assist with coverage analysis. Responsible for the appropriate execution of claims with exposures over $100,000 consistent with good faith file handling obligations and Claims Handling Guidelines. Undertakes necessary legal research and provides legal direction on any matters relevant to claims handling. Disseminates information to Claims. Trains, develops and provides technical guidance to Unit, Regional, Divisional and Litigation Claims Managers and their staff on issues involving any legal or claims related issues. Identify handling trends and issues and working with the appropriate cross-functional people, develop and implement the necessary training. Serves as subject matter expert for Operations, Marketing, Pricing and other department. Responsible for assuring the appropriate handling of complex declaratory judgment actions brought by or against companies. Primary responsibility for determining post-verdict decisions. Directly handles appeals. Responsible for maintaining and growing a relationship between Insurance and current policyholders. Also responsible for focusing on the needs of loss participants. Identifies customer needs and works to meet those needs using appropriate Point Of Difference skills. Demonstrates effective overall performance through consistent evaluations over multiple review periods. Demonstrates the capability of providing guidance, direction, mentoring and counseling, as well as a legal resource, as necessary on any claim. Has primary responsibility for providing guidance, direction, mentoring and counseling on all litigated matters and on casualty matters consistent with Claims Handling Guidelines. Maintains an active license as an attorney in at least one state. Has expert knowledge of claims policies and procedures and / or providing technical direction to claims personnel for claims handling. Demonstrates the ability to interpret and apply written coverage accurately to establish claim and determine action plan. Demonstrates expertise in the knowledge of applicable statutes, regulations, case law and procedures relating to personal lines litigation, including negligence, insurance contract, insurance coverage, no-fault (PIP), theories of liability, state and federal civil procedure and alternative dispute resolution. Demonstrates advanced expertise in the knowledge of insurance policies, provisions, coverages, rights and exclusions. Demonstrates advanced expertise in the knowledge and understanding of the tripartite relationship, Fair Claims Practices acts and bad faith. The candidate should have Juris Doctorate degree (JD) from an accredited U.S. law school and maintains an active license to practice law in at least one state. Must have 10+ years of related work experience in a personal lines property and casualty insurance company or equivalent law firm experience focusing on personal lines insurance or coverage issues. Ability to meet any in-house attorney licensure requirements is needed. Must be an experienced trial attorney. Should have expertise with litigation, arbitration and trial strategies and tactics. Advanced knowledge of complex medical issues, particularly orthopedic and neurological is required. Understanding of etiology, causation and treatment of injuries consistent with motor vehicle accidents is needed.
