Legal Counsel - Litigation

New York City NY Legal Counsel - Litigation The candidate will manage litigation for all business channels to reduce costs and ensure that the company's interests are properly protected. Research and analyze facts in litigation and relay to external counsel. Prepare, review, and/or revise all pleadings, discovery, motions and settlement agreements. Represent the company in depositions, mediations, and trials as needed. Obtain competent and cost-effective counsel and oversee case strategy for all pending litigation. Oversee pre-litigation dispute resolution and ensure necessary records and information are maintained to protect the company interests in the event of litigation. Report and distribute to senior manager and directors litigation reports as needed. Create periodic status reports and litigation reports for internal and external auditor use as well as for all regulatory filings. Proactively advise senior management and directors on potential litigation risks and liabilities. Obtain coverage under relevant insurance policies where possible and act as a liaison to insurance companies throughout the course of litigation. Oversight and management of indemnification claims and recoupment activities. Be a centralized point of contact between business units and outside legal counsel. Assist with day-to-day legal questions regarding potential litigation. Negotiate dispute resolutions, and various agreements with third-parties. In conjunction with General Counsel, establish policies and processes for selecting, compensating, and managing outside counsel, and other assistance necessary for investigating, negotiating, and litigating.

The candidate should have High-level multi-tasking with proficiency in organization, analysis, problem resolution, and case management. Excellent oral and written communication skills. Must possess high degree of discretion and judgment in evaluating strategy and problem resolution, while managing multiple deadlines across cases. Strong negotiation skills. Excels in a fast-paced environment. Proficient with Microsoft Office Suite or related software. Some travel required.

New York City NY Compliance and Litigation Counsel The candidate will play a key role in supporting growth as a public company. Primary areas of focus will include regulatory compliance, litigation and escalated customer disputes, privacy and data security, marketing and IP, and contract negotiation and review. Work on company's regulatory compliance strategy, including conducting research on applicable laws and regulations relating to automobile dealers, consumer finance, consumer protection, privacy and other areas. Conduct internal compliance investigations, risk assessments, and audits. Provide advice and assistance in the implementation of company-wide compliance programs, initiatives and trainings. Handle escalated customer disputes in coordination with customer support. Review marketing materials for compliance with consumer protection laws. Assist in building and managing IP portfolio. Manage litigation matters. Draft, review, and negotiate a wide variety of commercial agreements. Collaborate with and manage outside counsel where applicable.

The candidate should have J.D. from a top-tier law school. Must be member of the NY bar and in good standing,. 3 to 5 years of relevant experience is required. Should have experience with litigation and regulatory matters, including relevant state and federal regulations, such as TCPA, FCRA, TILA, ECOA and UDAP. Experience developing approaches to legal challenges while providing business-focused legal advice is required. should have experience learning new areas of law and regulation in a variety of jurisdictions. Excellent problem-solving capabilities, judgment, communication and interpersonal skills are required. Should preferable have An understanding of the auto or consumer finance industry. Litigation experience before federal or state regulatory bodies and federal or state courts is desired. Both law firm and in-house experience preferred. Contract experience a plus. Privacy experience a plus. Familiarity with state automotive licensing a plus.

Strategic thinking, with a track record of delivering pragmatic solutions to novel issues. Agility and ability to quickly assess business challenges and make timely recommendations under pressure. Significant leadership and managerial experience, with ability to effectively influence senior leaders and all levels of the organization in manner congruent with company culture. Ability to manage cases from inception to conclusion, with outstanding communication, legal research, writing, negotiation, and advocacy skills. Process-driven and results-oriented with proven ability to identify, prioritize and resolve issues quickly and independently. Strong project management skills, with ability to build sustainable programs for scale.
